Please help with response to RBS

Hi

I requested repayments on my CC. Have just had a response stating that they will not uphold my complaint as the policy was sold in 2002 and I cancelled a few mths ago. I cancelled because I had just become aware of the issue. They state that I am out of time to complain and that customers have a responsibility to raise concerns in a timely manner.

They then refer me to the FOS but state that in their opinion the FOS may not be able to consider my claim due the lapse of time since I became aware of that I had cause to complain (or ought to have been aware).

They then say " in exceptional circumstances the FOS may waive the time limit. Please let us know if you think this could apply so that we may re-consider matters."

Given they paid out on a single premium policy that ended in 2004, I am confused. I thought I could complain within 6yrs of the date that I realised there was an issue - i.e. Aug 2009.

Any advice??

    Hope your well.

    I would not worry what they say, and I'm sure there will be no problem with the FOS, give them a call if your worried about this, but remember its only in recent times we have all been aware of the mis selling of these policies, I think they are just trying to put you off, keep at them you will be fine.;)

    Its a bank - you will be fine, mine was successful with the FOS this year from a credit card case (ppi) from a sale in 2001.

  • Ah cool. I want to get a good letter out so that they may circumvent the need for FOS involvement!

    So I take it that the recent letter was not that of the final response?

    If not then write back and tell them despite you cancelling the PPI, you did so for your personal reasons and you were not aware until the mis selling of the PPI until recently and believe you have the right to request a refund of the PPI, with your reasons given originally, and then tell them you will take this complaint to the FOS with your evidence if they do not resolve/uphold in your favour etc etc......in your own words of course and then anything else you want to add to strengthen your case, good luck.;)

    I recently received the same letter from RBS and I responded with the same reasons you gave but they still said no can do. So I have now sent my complaint to the FOS. They have just acknowledged receipt of the complaint not heard anything further.
