Speed ticket 3 months old?!

Have just recieved an NIP yesterday, however the alleged offence was dated 6/8/09 as it is now 06/11/09 I was wondering if it was worth contesting. It says I was doing 37 in a 30 zone. And to be honest as it was soo long ago i can not be sure if it was myself or my partner driving at the time. Any help would be appreciated thanks.

  • The time limit they have for sending out a speeding ticket is 3 months so that's about right.

    Well I drove down the road it stated today and there was no speed camera that I could see. So It must have been a mobile camera. Also I had looked at other information regarding this and it mentioned that there is only a 14 day period from the offence to when they have to send notice...so now I am unsure about what I have read previously.

    14 days is correct. When did they send it? If it is a lease car, owned by a finance company or a company car it can take longer to reach you as long as the original ticket can be sent to the above first who then respond with your details and send it too you and therefore it can be valid.

    Yes as people have said, its 14 days. Can't remember off the top of my head when those 14 days starts and ends with regards to posting dates etc but it doesn't matter for you as its clearly well over. This rule does not apply if they've had difficulty finding you though, e.g. if you have an old address on your driving licence or anything like that.
    I'd write back and tell them its been well over 14 days and see what they say. They should reply fairly quickly and give you extra time to pay if they still want paying. I think there's a template letter on Pepipoo for this.

    Actually, it's 14 days. Keep the envelope - when was it posted?

    The Notice of Intended Prosecution (NIP) arrived outside of the "14" day period. You should be able to get the prosecution dropped - get our lawyers to write you a legal letter and it should go away. This is assuming that you are the registered owner of the vehicle.

  • I think the 14 days is from the offence until they do something, so if they write to the registered keeper (if thats not you) then they may take up to 28 days to reply.

    My partner filed in the form to say she was driving a while back and they wrote to her with the photos stating that she had lied on the decleration as it was clearly a man driving!!! I was surprised how clear the potos were - no denying it was me! They gave her 7 days to "reconsider" how she had completed the form
  • As long as you are not the registered keeper and/or have moved address and not updated the V5 the 14 days may not apply.

    Please clear up this point then you may have a defence.

    How can you be expected to accept committing the offence without being provided with the evidence against you? This means you need to be 100% certain you were not over the speed limit before you let it go to court. The only way most motorists could know this for certain is if GPS technology was installed in the car that could prove the speed travelled at any given time. Amounts to legalised extortion IMO. I'm sure there are many who are certain they were not speeding and take it on, with many winners and losers each way. That there are winners proves this is extortion.
