Please could someone give me some advice.
I have had an M&S chargecard since 1994 with PPI.
I had an accident in Jan whilst working for M&S on 6 month temporary contract.
I have not being able to work since, my contract was not renewed due to being unable to work and I am waiting surgery.
I have PPI cover on 2 other cards.
In april I put in a claim to them all. The other 2 accepted my claim and have been paying each month.
M&S took 4 months to come to a decision and declined my claim. They said that as I had not been in employment for 6 months or more they would not be paying out. I was just 2 days short of working 6 months!
I am so annoyed that I have paid out so much PPI cover for 15 years and they are not paying.
I am struggling to make the minimum payments each month and they are charging £12 late payments and hassling me for the payments.
Could someone advise me of what I could do?
Thanks

Hello there and welcome,
sorry to hear of your problems here and hope things get better for you.
I would maybe jump hoops here and contact the Financial ombudsman service (FOS) ring them and ask if there is any way they can help you through this, on your behalf.
Explain what you have above to them and they should be able to at least advice you or help on your behalf.
Contact details of the FOS here:

Wishing you luck with this and please let us know how you get on.;)The one and only "Dizzy Di"

Hi
Thank you for your suggestion. I will give it a try and let you know.

What a blow!! It does seem a tad unfair of M&S (or rather their underwriters) not to pay out on your claim...
In the alternative (and not wanting to put ideas into your head) - is there any genuine reason why you might think that the ppi was origionally mis-sold to you???
Fifteen years of payments must add up to a fairly tidy sum....
The very recent case in Newcastle (MBNA vs Thorius) was a case where MBNA had effectively 'sold' a credit card (through Sunderland Football Club) and - among other things, the court held that because MBNA had failed to disclose to Ms Thorius, when the credit card was 'sold', that they (MBNA) receivied a commission on the PPI from the underwriters.... PPI was unenforceable because: "an unfair relationship had arisen within Section 140A of the Consumer Credit Act 1974 in the light of the standard advice to the Defendant to the customer to take out PPI when combined with the receipt by the Claimant of undisclosed commission. The appropriate order pursuant to Section 140B of the Consumer Credit Act 1974 " and ordered the return of the PPI Premiums (plus interest at 8%).:AIgnorance can be cured, but stupid is forever!:A

I have had similar problems with my old M&S charge/credit card they refused to cooperate. I went to FOS who decided to follow up my complaint with Allianz insurance.
Within a week of recieving the FOS complaint they wrote to me coughing up £700.
Come on guys and gals go for it !!!0 -
