New Front Door

On the 7th September a rep from Wholesale Plastics showed me a new composit front door in his brochure. As the company was already updating our conservatory, it seemed appropriate to order the new front door and we paid a deposit. What we did not know at the time, was all the problems we were going to have with this company and their fitters, what should have been a three day job, turned into a nightmare that lasted five weeks.

As I was unable to leave the bungalow at the time, I did not get a chance to see what the door would really look like and we really should have taken time out to look around. The rep informed me that the price was excellent and from what I could see on the internet it did seem a very good price.

Because of the problems with the company, we are sure they delayed the door, although we have no proof and since we have paid for the previous work with a reduction, we did not expect the door to arrive at all.

I have since seen these composit doors and it may sound strange to some, but I don't like the look of them, plus, we don't like the idea of Wholesale plastics fitting it after our previous experience with them.

So my question is, if we don't like the door they deliver, do we have the right to refuse it and not have to pay the remaining cost. As the rep could not show me what the actual finish would look like, only in a brochure and was quite pushy to sell, where do we stand?

Bit of a mystery this one. If you did not like the product and you did not like the fitters workmanship, and you had a pushy salesman. Why on earth did you order a new door from them. I doubt whether the contract will give you the right to cancel just because you do not like the product when it arrives. Installations of this type are made to measure.
On the other hand, are they likely to take you to court for the comparatively small amount of money involved? Maybe A6windows can offer an opinion
I can afford anything that I want.
Just so long as I don't want much.

The door was ordered before the work had started on the new windows etc, so I had no idea that the workmanship was going to be so poor, plus the damage they caused to our carpets etc.

I've been in touch with consumers direct and they have advised that as the contract says
'If the cusomer is unhappy with the contract for any reason, it can be cancelled and a refund of the deposit (less 50.00 if surveyed) can be obtained by giving notice in writting addressed to the Company at (address) sent by recorded delivery within five days of the date on which the contract was signed'
the contract is not inforcable due to regulations 2008 that state a contract has to give seven working days and can not refuse return of deposit.

However this is not writen in stone, but trading standards are willing to take it up on my behalf. The thought of that fitter coming to my home and causing more damage fills me with dread.

Whether it is 5 or 7 days is irrelevant given that you signed the contract on 7/9-that is 2 months ago. Surely they will already have manufactured this door by now so they are entitled to the full cost if you cancel. I don't think TS have given you sound advice.
I suggest you insist on a different fitter for the door (odds are against it being the same one anyway).
I had the same issue with DG fitters years back, the first day they sent a team who were clueless. I said I would not acept that standard of work. They then sent a different guy who fitted all the other windows to a high standard and put right the bodges of the first lot.

A contract of this type is no longer enforceable at any time if it doesn't contain the prescribed 7 day cancellation notice. The rules changed in October last year. More info here: http://www.berr.gov.uk/whatwedo/consumers/buying-selling/Doorstep-selling/index.html
