Have you checked the b'card one with the prescribed terms from page 1? If so and it doesn't look right you send the same letter - its always the same process dependant upon what they send you - so a failed (or unlawful copy of a CCA) would mean you send the query letter2010 - year of the troll

Any thoughts on that LTSB Visa on the last page in terms of why you would deem it unenforceable so I can maybe put more info in my next letter to them ?

Hiya mate - when was the card taken out? was that upload one page or two separate pages and does the rates advertised on page 2 tally with the original or has it been doctored?
I cannot check the CCA's for obvious reasons mate but I will say whether I think they are unenforceable from first glance - the fact page 2 is separate is one thing, there is no lender signature or date is another, the fact the logo is shadowed is another, I cannot see the original so do not know if the rates on page 2 tally with the original.....
On page 1 it says 'the agreement overleaf should be read and signed' - thus I need to know is page 2 a separate page or is it the back of page 1? see my point? Has to be one contained document mate or lead to additional pages, so if it says read overleaf and there is nothing overleaf then its wrong!2010 - year of the troll

Is the fact that my name and address don't appear on page two - the actual CCA - another issue for them?
Page one is the application form which DOES have my name and address on it but page two is the CCA which doesn't. I cannot for the life of me remember if the documents were on one single page - two sides - or two different pieces of paper.
I think what Lloyds do is scan their paperwork on to a computer and when you request a copy it's printed on to Lloyds headed paper so whether they have the ORIGINAL is anyone's guess. It could be in a warehouse somewhere stored away. I don't believe we're seeing copies of the ACTUAL original, more a scan of the original from their systems.
The card was taken out in 2005....

Part of s.78 would mean they send statements or other documents - is there anything you have from 2005 that shows the rate (statement maybe?) and does this rate work out the same as the CCA they sent you.
Yes, your name and address needs to be on the CCA - I told you this the first time roundSo far i've seen several errors and listed them in the last post but only if you can remember what the original said - have you not got your own copy to compare with? (do not answer than on here in public)

Hi Guys,
My friend has sent a CCA by next day special del to Barclaycard but not had any reply in 12+2 days nor the CCA reminder but has just received a letter from Mercers saying they are acting on behalf of Barclaycard saying the account is overdue and we have no alternative other than to pass your account to:-
A local debt collector who may call at your home to obtain full payment... etc
What letter should he send to Mercers and also to Barclaycard? Thanks0 -
