  • LOL, they tell me that it'd be pointless pursuing unenforceability (unfortunately).... :mad:

    Thaks for that NID, i'm still waiting for the other 2 CCA's so hopefully something is missing from them.

    I really am grateful for eveyones help so far :T

    Are they jumping on the band wagon trying to generate business (i.e. that the bank pulled out - not that they won)! Thats dire, shows how sad they are - thing is it is scum like that that not only open the floodgates with new cases but also help to close them with their spamming! Grrrr :mad: :mad: :mad:

    Yes - send the same letter. They may well fob you off but they shouldn't. You can always SAR them anyway, but knowing HSBC they will have sent the overdraft agreements - its usually a few pages long (at least 2) and comes just after the overdraft was agreed. :D

    Its annoying, even looking at the courts themselves doesn't show much. Try googling: Manchester Mercantile Court (where the test cases are being held) :D

    I already have. ;) The "court lists" don't tell you anything either. :confused:

    Right have had three responses to my CCA requests. HBOS can't find anything but are still looking! :rotfl:

    One is after April 2007 so does not fall into the bracket.

    The other CCA is for a CC from 2001 and is a signed application form, it's a good copy but there is no mention of interest rates or payments.

    There is attached to the photocopied application 4 pages claiming to be an agreement with references to payments and interest charged. Looks like a generic computer generated agreement with my name and address typed in which looks like the current terms and conditions.

    Is the signed application form a valid agreement?

    I need some advice
    One of my relatives has told me they are paying several DCA's small monthly payments for some debts which they got done through the Citizens Adice Bureau.
    They have said all were before April 2007.

    I have told them to try and send the CCA request to the DCA, but they are scared of doing so as they are worried their credit rating might be damaged and they might be defaulted or something.

    Is it worth them having a go and sending the CCA?
