never-in-doubt wrote: »Right forget F&F - what is the point? If thats the way you want to play it and make silly offers then go see an insolvency specialist and offer them the £10k to share between your creditors as full and final payments. i.e. do an IVA! - You can't do a mainstream IVA cos you aint working so cannot repay a set monthly amount so try and do it using a lump sum as settlement.
Alternatively, use the following letter which tells them you'll make an offer ONLY if they remove all the derogatory data and it even spells out what to do with the credit report! 8. Default Removal - Offer of F&F Settlement
Ok, so assume you want to forget the silly idea above - you have to sit back, calm down and think seriously what you want to do. Of course there will be the odd threat, they will do it once, i'll then sort you a letter and they will stop. They tend to hassle you more for the first year afterwhich they calm down a little.... year 3-6 you hardly hear from them (assuming you just send back any letters that they send you as unknown at this address)...
Yea, ethically it's bad but so what! You're not renting/homeowner so you're in the best position to do that! i.e. go underground for like a few years!
Your third choice is to argue for unenforceability (so what if they are enforceable) - the worse they can do is default you and send a bailiff - wooppeee! They still can't do anything to you - bailiffs have as many rights as your next door neighbour - NONE
So, what's your next move then? I hope that you were taught a valuable lesson when you spoke to MBNA - DO NOT SPEAK TO THEM!
Thanks once again NID i will listen to that and be tough from now on. Just one last question. How does it affect my parents that i am back home for the near future? I am hoping you reply not at all
Sorry i never thought that my pointless posts are clogging up the thread

Yep I sent the CCA request so what I'm looking at IS their response....not my own original CCA copy or nothing like that
Im gonna try and get this scanned so I'll hopefully be able to post a copy of what they've sent in about 10 mins...will you still be about?
Thanks

Your posts are not clogging it up lol, but try to keep on track and not post 5 one after another! Make it one bigger post! lol
It will have no effect on your parents, how can it? It is your debt, not theirs. The only problem may be the calls and maybe one visit from a DCA.... that would be worse case scenario mate..... but if a collection agent does write saying they will visit i'll sort your reply to them before they do come and if they do, they have then breached the terms of holding their licence and you report them accordingly. Don't worry! Have a read here to see the law on bailiffs! Dealing with Bailiffs Harassment2010 - year of the troll

Thank you once again. Will print a few of these posts to put my parents mind at rest.
I suppose if i have nothing they cant take nothing off me, although they have had thousands upon thousands off me in the past.
Right i have made my decision time to ignore them totally!0 -

Go for it mate...... well done.
It may be worth you paying to change the landline number, then there will be no hassle. Or certainly pay for that thing that stops witheld numbers from ringing so it must show the actual number before it rings at your end....
Remember we're here to help - don't worryI'll even ring and tell your mum that it's fine and not to worry haha :rotfl:
