Brodit Car Holder damaged new HTC Hero Phone - where do I stand?

Difficult one this. You could argue that the holder isn't fit for purpose as there is an inherent fault in the design that causes damage to the phone it was intended for. In which case the retailer would probably only be liable for the purchase of the holder. The damage to the phone would probably have to be claimed against the manufacturer though.

Having said that, when using these types of cradle isn't it inevitable that you're going to get some marks and scratches through the everyday use of pushing the phone into it and removing it again.

Cheers for your post. I know.....it is a difficult one. I will probably go down the road of getting a "flexishield" skin cover for it. That way, at least I'll not be viewing the mark every day - it will actually be covered by the silicon skin cover. However, it's the principle they have put a product on the market which marks phones and I may get them to honour the cost of a full change of casing when I decide to sell the phone. Therefore the look of the phone will look "as new", and worth more.

I'll try and be positive in this post.

OP if it didn't hold it securely then it wouldn't be much good. In a few months you probably won't even notice the marks.

£450 for a phone, the world has officially gone mad.

I hope you're not the person who declares everything official to do with the world if you're years late to notice things :p

Nope. That's how much phones, especially ones like this, cost. You may not notice as your phone is on a contract and therefore subsidised by the network, or you just buy cheaper phones. :money:

I have an HTC Touch HD which was £35pm for 18 months on O2, or £550 off-network.

I can totally understand how annoyed you are that your phone has been damaged by the holder, but I fear you may be embarking on a losing battle. You may be able to negotiate a good will gesture, such as a refund on the holder, or discount on a case for the phone. Also bear in mind that with all the will in the world, such devices will collect damage in use.

  • Nice reply . The phone, if purchased sim free is around £450. I'm paying £35 per month for 2 years.....

What part of "Money Saving" don't you understand?
It's taken me years of experience to get this cynical

I have a BlackBerry Bold (which is a far superior phone to the HTC), and that also has scratches. These were caused by me.

If the holder wasn't supplied with the phone, then it could be inadvertently said you caused the damage.
