central capital woes

hi there
i recently sent off a ppi reclaim to central capital regarding misselleing my ppi
i recieved the responce today saying basically i wasnt due a refund as it was sold correctly
i have to ring tommorrow to get a password for the disk they sent me of the conversation with the sales person
my question is this
i would like to listen to this cd and have all the relevent details to hand of anything they have may slipped up on
has anyone got links to all the parts of a reclaim i need please
i tryed on the points pushy sales person, wasnt told the length of the ppi,the policy was optional and sales person had no financial back ground but they responded saying it was all advised in the conversation on the cd
any information would be gratefully apriciated so i have it to hand tommorrow when i listen to the cd
ii was told they would try and say no but im sure ill find something in the conversation i wasnt advised on properly
would the next best step be a solicitor on no win no fee or the fos?

If they do not uphold your complaint and you have a final response (I take it this letter is not one yet!!) then FOS is your best bet if it within their jurisdiction that is as its all for free but you can have a long wait.davesy5250 wrote: »hi there

Each persons misselling complaint has different reasons but their are a few mentioned in the guide.

I have exactly ther same problem with CC. I sent my initial letter at the end of September and I got a letter back from them last week saying that they were not upholding my complaint. hey sent me a disc also which I have carefully listened to. I have read a lot about the FSA Principles and the way the FOS deal with these complaint, I don't think CC have a leg to stand on but they continue to dismiss our claims. I was clearly pressured into buying the PPI and the quotes automatically included the PPI. I have now referred my case to the PPI and now have a long wait ahead, it will be interesting to tract each others progress though.0

ive now listened to the cd of my conversation and in fairness the points i raised in my letter of complaint were actually dropped into the conversation at some point
i have a few queries and hope someone can answer these if possible
altho this was for the loan application the operative was blinding me with figures and also kept saying "thats a saving of £xxxx per month on your current outgoings" which did sound good also at one point he advised me to borrow more than i required for my consolidation so as to have a back up fund
is this classed as a pushy salesperson teqnique i could use albeit for the loan not the ppi?
back to the ppi now
in the conversation he asked if i had life cover to we i clearly said yes but he said ok and started talking about something else
at no point was i told the ppi policy wasnt in monthly installments or a one off payment and was never told the total cost just total amount of loan payments per month including ppi
he then got about the cashback saying at the end of the 5 yrs i would get back 7673 pounds back and straight after said if i didnt get more than 2 months behind on payments but to fair i was so taken aback at the figure i didnt at the time ingest the information is this a valid point to use
also there is no information on this cash back in my ppi policy information i was sent by the complaints handler and told to read
im also lead to believe there is a 30 days claim period for this cashback money which was never mentioned is this true??
im going to relisten to the cd tommorrow to see if i can pick on any other bits of info but its 45 mins long lol so need a rest
any comments and info apricated
any more points i need to look for in the convo?
should i just accept that i wont get any money back or send my findings back to central capital and ask to reconsider my complaint

Good luck with this. Although Central Capital accepted the FOS adjudicator's decision in August that they had mis-sold me a PPI I am still waiting for a payout. And, yesterday 7th November,I received a letter from CC stating that they are now putting my settlement on hold as they are "seeking clarification from the FOS about the the PPI complaints redress process". This is based on legal advice they have now taken.
It would be interesting to know if anyone else out there is now in the same position?0 -

They are salespeople. They are trying to sale and it is a sales process. You should expect the sales patter. And this is a problem for you and so many others. Especially those that use template letters. If you state things in your complaint that are easily proven otherwise then your credibility drops. In areas where a balance of probability decision needs to be made, the decision usually goes to the most credible side.at one point he advised me to borrow more than i required for my consolidation so as to have a back up fund

Nope. That was normal for the time. Basically, when you credit score, they are told if you could borrow more or not.
The problem you have is that most loan/credit card PPI complaints win because there is no evidence from the company to support how it was sold. In this case, there is and they believe that it is enough to be compliant.
Whether it is or not, we cant say. Too many of them try to refuse and get overturned when you go to the FOS. However, they do have evidence in this case and you have been found to be incorrect in a number of your complaint points so that does put them in a stronger position than most.I am an Independent Financial Adviser (IFA). I am in the EXACT same position here. my complaint was settled 2 weeks ago and i was waiting for the payment. then last night i had a letter stating on hold for the exact same reason.
I called the FOS and they know nothing about it. Itsreassuring that its not just me who had the letter so i think they must be telling the truth about this if we have both had letters. and its not like they can actually dispute the complaint due to having an offer and acceptance (im hoping anyway)
if you can email me wlowe280375@hotmail.com so that we can keep in touch with progress on this as I was due the payout this friday and now its not at least until the end of nov subject to them obviously.
i think we need to make sure that they are not just fobbing us all off here, i cant see that they would but just to be sure0 -

So sorry to hear this, I would as well if you can, if you have a printer, try to print off the email, and enclose it with your complaints form.

just realised it was central trust not central capital
i took the case to the ombudsman and the ajudicator upheld in my favour
central trust rejected his decision so im now awaiting a responce from the ombudsman himself
more waiting now lol0
