Tiscali are haunting me

Hi, I wonder if anyone can advise on a problem I am having with Tiscali broadband

I left them and signed up to Talk Talk a bit more than two years ago. I properly left them, cancelled my account, broadband went dead and I stopped getting statements.

Yesteday I got a letter from them demanding £270 which they think I owe for broadband services since them.

I've emailed them and told them I don't. They replied that according to their records I cancelled my phone service but not my broadband (I have never had a phone service from Tiscali).

They have said that, to progress the matter, I need me to send them my Go Live letter and first itemised bill for any new provider. I don't see this is really their business. What if I just decided not to have broadband any more?

But the real reason I'm hesisating is that I am now with Talk Talk, which has bought out Tiscali's UK operation. So I am worried that as soon as they know I am a Talk Talk customer, they will be able to use this information to get the money they say I owe them sucked out of my account by Direct Debit.

Does anybody know if that is likely? And what should I do?

I really feel like I should just ignore them.

Many thanks.

I previously had problems with Tiscali however in my case when I cancelled I did it both on the phone and in writing, and they replied to my written letter 3 months after I sent it. They subsequently send me a cheque then 6 months later set up a direct debit to take some money out of my bank account. I used the direct debit guarantee to get the money back and cancelled the direct debit. They then asked me again for the money so I threatened to take them to court for breach of contract. They have since left me alone.

I suggest you write a letter to Tiscali with the title "Letter Before Action" in the letter threaten to take them to court for breach of contract if they continue to insist that you didn't cancel your broadband with them as you have evidence to show that you never received a phone line from them. And they will be liable for all costs incurred. Send the letter to them by recorded delivery otherwise they will claim not to have received it and keep everything.

If they do hassle you again then start court action. You don't actually want any money from them you just want them to leave you alone so go for a low amount to cover the cost of postage and telephone calls and add on the costs of court action.
    I'm not cynical I'm realistic :p

  • Many thanks Olly. Only thing is I'm not sure I do have evidence of my side of things - it seems to me like it's my word against what their system says.

    Thanks.

All you can do is send them a copy of your Talk Talk activation letter and possible the first bill as they suggest. Don't be so paranoid regarding any Tiscali TalkTalk connection, they are still two seperate legal entities in their own right and Tiscali wont be able to access your Talk Talk DD.

If Talk Talk have bought Tiscali's UK area, would it be worth you phoning Talk Talk as their customer about the Tiscali issue..? Tell them about it and say that you're thinking of taking court action out on Tiscali and so it wouldn't be in anyone's interest for you to stay with Talk Talk and you're worried that Talk Talk will be the same as Tiscali re service...? Is a long shot but if you get right person on the phone, they might be able to wipe that for you?
