TBI Financial Services

Can someone give any advice regarding TBI Financial Services please.
To cut a long story short, around ten years ago I had a loan with HFC Bank for £5000. I had to give up work due to injury a few months after taking out the loan and agreed with HFC to make a reduced payment of £20 a month. After another few months I got a call from HFC asking me if I wanted to pay off the loan for £1500. It would have been a great offer but at the time I could hardly scrape together 1500 pence. I then received a letter from TBI informing me they had taken over the loan and they wanted £7000 or they would take me to court. They took out a CCJ against me and subsequently a charging order. This was in 2002. Since then all I have received from them is a letter couple of years ago telling me I now owed them £11,000. But they tried to call me last week and I have now recieved a letter informing me if I don't make arrangements to pay them they will enforce the court judgements.
If anyone can steer me in the right direction I would be very grateful.

Whilst a charging order/CCJ does prevent a debt going statute barred, but as they have not enforced it for a period of 6 years they would have to return to the courts and say why no attempt was made to enforce it before now, to get it sort off reactivated.
It maybe possible that if the court refuses the application the debt could be made unenforceable by sending off a statute barred letter. The courts original judgement should have been enforced back in 2002 by TBI, as its unfair to pursue a debt after so long if you haven't paid or acknowledged it.
I assume the CCJ and charging order was successful, did you attempt to defend your case in court? I'm not sure but others might know if this makes an impact.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies0 -
The CCJ was made in my absence and I cannot find any papers regarding it. I attended for the charging order and basically a solicitor asked a judge to grant a charging order, he did and that was it, in and out in five minutes.
I've been in touch with a company called clearunfaircredit and they are sending me a pack.
Is there anything I should be doing in the meantime?
Thanks0 -
Is the company clearunfaircredit charging you, anything they can do you can do for free. Free professional advice is available from National debtline, CCCS, PayPlan and CAB. I would advise giving them a call and setting up a free account with them, people on here can't recommend them enough for the help they provide for free.
As there is already a CCJ & Charging order on this debt, i personally wouldn't know what would be the best course of action, long term forum members like 10past6, never in doubt et.c are probably more knowledgeable in this area.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

No they are free. I also tried Kerobo Claims but they said it would cost between £300 and £500, thats why I contacted clearunfairdredit. I am expecting a pack from them early next week. Here's hoping they can help, I'll let you know0

I would still give the above people, atleast National Debtline a ring for a 2nd opinion.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

Hi guys
Its been a while but here's hoping
I sent off for a copy of the original credit agreement under the Consumer Credit Act 1974 from HFC bank around 12 months ago but received nothing back.
However I have just received a letter from TBI finanancial services headed "This statement is being given to you as required by the Consumer Credit Act 1974. This just contains the amount they claim is owed, no copy of the agreement
Can someone advise on where I go from here, any help will be appreciated
Thanks0 -
Anybody got any ideas please0

There's a gap in your thread. Did you contact National Debtline or continue with clearunfaircredit? If so, what happened?0
