Windows 7 Problems with Dell

I am thoroughly annoyed with Dell and am wondering if there is anyway to reach anyone with intelligence there?!
I bought a computer a month or two ago with an upgrade to Windows 7. I could have bought elsewhere but Dell have previously been quite good so I ordered from them with the promise that the Win 7 upgrade would be shipped shortly after release. I registered as advised and received confirmation that I would receive an email when it was time to order my copy. 22nd (Win 7 release date) came and went and no email. Several days later I was browsing the Dell forum and saw some information and posted asking questions. The poster told me that the Win 7 would be sitting in my basket and to login and place the order. I did this and received no shipping date. I went back to the salesman I dealt with to complain that I hadn't been told to order it and that I had no shipping date. I have issues with Vista and I've put off loading newer software until I get Win 7 - so it's a hassle to wait. Many calls and emails later and he can't help, neither can he get hold of the Win 7 team and they are ignoring my emails. I threaten to return the PC and he promises to get back to me in 24 hours. 24 hours later and no movement except another call to say he's stumped - he can't get an answer himself - perhaps I could call next week? I refuse and say enough is enough. At this time I get a shipping date of 3 Nov. It's not ideal but I agree to wait.
3rd Nov - nothing new on shipping info and no tracking number. Yesterday I login in again and my shipping date is suddenly 15th Nov! I am furious! I email the Win 7 team again and tell them that they have 4 days to get it to me, otherwise they either order me a copy from Amazon (who can deliver by Friday) or they refund my entire order and come and collect the PC.
I get a reply that says they have managed to confirm that my shipping date is 15th November. NOOOOO really? Isn't that what I just told them!?
I am now livid and it seems that there is nobody in Dell who gives a damn.
In my view the Win 7 upgrade was a part of my contract with Dell that I entered into when I purchased the computer. They are failing to fulfill their part of the contract and therefore I can take this further. But how? And I am actually correct in that assumption?
What can I do? I really don't want to wait until 15th November!

I sympathise with your Dell issues; I am not thrilled with my own dealings with them either.
I'm not sure though that there is very much you can do to improve on your current situation. The 'promise' of a free upgrade did not specify a time period so I don't see that you have a contractual right to take up with them. At a practical level, it would probably take longer than the 10 days between now and 15th to get the attention and action of anyone in Head Office ... so you may have not very much to gain in return for your time and energy.
I sympathise with you, I really do, but I think you need to weigh up the costs and benefits of taking this further. If you are sufficiently annoyed, then I'm sure it would be possible to find the contact details of someone to take it up with.0 -

No? explain why! I have a computer that I can't use to capacity because I cannot install some software packages that I need to use until Windows 7 is installed. That is a major hassle for me - particularly as I expected to receive it by the end of October and had planned for that. All of which was discussed when I bought it.
So for you perhaps it wouldn't be a hassle - for me it is!0 -
As far as I know, all software for Windows 7 is also compatible with Vista.Squirrel!If I tell you who I work for, I'm not allowed to help you. If I don't say, then I can help you with questions and fixing products. Regardless, there's still no secret EU law.

Just out of curiosity, I was thinking of upgrading from Vista to 7 and wondered about program compatibility ...what programs won't run on Vista that need 7 to run?I'm now a retired teacher... hooray ...:j

Drivers are more of an issue than software. Windows 7 has a compatibility mode for software which hasn't failed on me yet.
90% of vista drivers install using this mode, but some have failed on me trying to upgrade vista to Windows 7.
Check your PC manuafcturers website for updated drivers prior to buying or download a windows 7 trial and see if the installation goes ok.
With regards Dell, I wouldn't buy from them as I can't understand there customer services and they can't understand my Brummie accent.
