Broken item, refund different card (same account)

I've got a bit of a problem and I'm told you're the people to help me out with some advice.

As simple as I can make it;
Last week I bought a game with specific controller (the game only works with the controller, it's DJ Hero btw), the controller has broken within a week. I bought it at GAME online using a credit card.
Looking on the website it looks like I can return the item to the high street store (GAME) for a refund as long as I take the receipt and the card I used to pay for the item.

Here is the problem;
Since buying the item the bank closed my card account due to suspected fraudulent activity, I now have a new account and card. Upon explaining the situation to the store they would only offer store credit, I refused saying I'd like a full refund but there were no signs of them moving.

What do I do now? I am entitled to a full refund aren't I?

  • The game was £90, I don't really want that much store credit for GAME, I usually buy my games cheaper elsewhere. I'd prefer a full refund simply because I believe the build quality of the controllers to be of such poor quality that a replacement would only be a temporary fix for the problem, there are various reports online about the same problems I'm having with the controller, so it isn't a one off.

    A week sounds like a "reasonable time" (according to the Sale of Goods Act) in which to ask for a refund. The goods are faulty, so I'm fairly sure that you don't have to accept a credit note. Being told that this is all you are entitled to may well be illegal.

    As far as I know, there is no legal requirement that refunds be made using the same card/account, although I believe some shops try to get you to do this to reduce their exposure to potentially fraudulent transactions or money laundering.

    I would insist on a full refund and sue for damages if they do not comply.

    If necessary, you can submit a legal claim via http://www.moneyclaim.gov.uk/.

    as above there is no legal reason for them to insist on refunding to the same card

    there is however a legal obligation for a full refund, meaning they must give you a full refund, in cash if needs be!

    your statutory rights trump their "procedures" every time



    go in again stating you have gotten trading standards involved and they agree with you (as they will) and that you demand a full refund in whatever means they see fit, cash or debit card.

    they will jsut have to adjust there numbers later on

    oh and if they want your address you dont have to give that as you are exercising your rights;)
    Back by no demand whatsoever.
