    I meant that the son could not receive Carers Allowance and the Mother also receive SDP, I was not talking about the Mother receiving Carers Allowance. Yes I know she could get the SDP and not live alone but in this case she would not get the SDP as her son lives with her.

    your mum may be on something called Severe Disablement Allowance, this was paid to people who were sick but did not have enought NI conts for getting IB (which it is now) she would of been able to stay on SDA if the SP was going to be lower than the SDA.

    Yes, the CA has to be in payment before the SDP is disqualified.

    As I thought, she is in receipt of DLA, which was called something else when she applied but as it was for life she transferred over to DLA. If she were to re-apply now it would be for something else (attendance allowance I think), which would be for the same purpose but for over 65's.

    Brother also been told that the DLA care element is a separate claim so mum keeps DLA mobility that she's already receiving and will have to claim care element in separately.

    Does that sound right?

    As it stands now, I understand from replies here and direct.gov:
    1. Consensus seems to be that pension will be made up to £130 as a single person with pension credits.
    2. Mum can continue in receipt of DLA mobility element (£49.10) uninterrpted even though she is over 65 because it is based on original application under old allowance name.
    3. Claim for DLA carers element middle rate (£47.10) in addition should be next step.
    4. Following on from 3 (if successful) carers allowance (£53.10) can be claimed by brother.
    5. SDP can be eliminated as a possibility because my brother lives with mum and also 4 above would exclude this claim.

    Just found out this is the case so already in receipt of SDP BUT this is in lieu of pension entitlement and because of insufficient NI contributions.

    As in OP, mums future single entitlement to £130 pension as the minimum is uncertain without pension credits and much seems to hinge on this entitlement. Sorry if this is repeating a point but does anyone know if SDP and pension credits are in lieu of each other?

    you getting confused SDP is a Premium on Pension Credit but as you state your mum does not live alone, SDA is seperate benefit and this will be taken off any appropirate amount of Pension Credit, in other words if her approiprate amount is £130 per week and she has £60 SDA per week and had no other income and savings, then Pension Credit would pay £70 per week
