returning the car I bought

Hi,
Hope this is the right place for this questions. In August OH and I bought a second hand car from a dealership. We immediately noticed a problem with it on its first long drive, an issue that only appears after the engine is fully warmed up. We went back the following week to see about it, and have spent the last 2 months trying to get it dealt with.
They have been so incompetent, the problems are quite large and its taken so much of our time that we now just wish to give the car back. I've read on the legislation about returning the car, but the dealer says because its been 2 months, its too long to return it. But we fist went to them with the problems after one week. Does anyone know the legalities of this and whether we can return the car with a full refund? The dealer says they will fix it for free, but thats not what we want anymore.
I hope someone can help with this. If you need more info before answering please say.

would you let someone return a car to you after 2 or 3 months?
Maybe a couple of weeks but not months0 -
I would let them fix it for you. If your completly disheartened with your car, get it fixed and sell it0

My problem is that we tried to sort this out after one week. We haven't used the car hardly at all as we're worried about making the problem worse. Its been returned to the garage for 'investigation' 7 times. And they were useless everytime. And its a big problem with the gearbox, clutch, driveshaft, and we paid money that was representative of a car not having these kind of issues.0

There should be a cooling of period when you brought the car. Did you request in the 1st week you wanted to return the car? Did they say they will fix all the problems with the car?0

Thanks Blue_Diamond. This has crossed our minds as an option. Its just the time and energy involved, I already work 3 jobs and have so little time and energy for dealing with these things. Might be our only option if the law isn't on our side.
The legislation seems to say anything under 6 months isn't a long time, especially since we went to them with the problems in the first week. Didn't know if anyone else had had experience of using the law to return a second hand car.0 -
We didn't request in the first week to return it, as we thought it might be an easy problem to fix. But its taken them this long to find what was wrong, not because its complicated but because people were away, they thought it was something else, different people looked at it etc. I just don't want a car that has this many problems at quite a young age as I don't think it bodes well for the overall state of the car.0

Dont think you're gonna be able to return the car now. In effect, first time you went back you accepted a fix (or not)....0

Either you can take this to a small claims court...or personally, I would get the car fixed from the dealership and sell it off.0 -

Thanks for the input. If they'd found it was such a huge fault at the first visit I'd have asked for a refund. I understand now a lot of time has passed, even though we haven't really used the car. Maybe I just have to keep everything crossed that once they fix it that will be it. I'm not convinced. And I think its unfair that a company can stall for enough time to not have to accept a return.0 -
