Employer Fast Tracking Selection

I work for an Anglo-Dutch company that is outsourcing a department to an Indian outsource company. This will result in approximately 50 redundancies out of 150 staff.

Consultation with the UK Staff Council has occured and we have now been formally told the numbers of people who are going , the reorganised structure etc. Consultation with the European Works Council is on-going with final responses not expected for the next month or so.

Nobody has yet been given the formal "At Risk of Redundancy" letter but one-to-one consultations have already started and we are being asked to specify up-to three roles we are interested in and supply a CV in a specified format. Some are being told that they can TUPE across and also need to indicate whether they would be interested in doing so.

The intention is that once the European Works Council signs off the proposal then they can immediately impliment the new structure and place those without a job "At Risk".


My first question is really a confirmation that even though it seems unfair to be doing the reorganisation before signoff, they are not doing anything illegal.

Secondly, can some people be told that they can TUPE across whilst others are told that they cannot?

Finally, can the outsourcing company be on-site having meetings with management and the teamleaders before European Works Council approval or a legal contract with this company is in place?

    The short answer as far as I'm concerned is Yes Yes and Yes.

    TUPE/REDUNDANCY on such a scale across various counties is always going to result in some overlaps of process. From what you have posted I can't see any major problems with their approach.

    I doubt the EWC will change the proposals or have any bearing on the timing/legality of the UK process unless there is specific company policy relating to this.

    Some roles will be able to TUPE - others will be made redundant. This is commonplace and giving people a heads up on thsi as part of individual consultation is only fair.
