If this were the case then people would be able to have large property portfolios and still be able to claim means tested benefits!

An update in case anyone still wants to follow this case. My friend moved in with me for a month at the beginning of the year while looking for somewhere to rent as the rest of the family did not want him to continue living in the family property

Probate has been granted but the property has not yet been sold and has been empty for 6 months and he has not yet received any of the inheritance, so still living on benefits which includes rental of the flat he is now living in

Yes, I think they thought without him living there the property would sell quicker. He's actually been back to cut the lawn, he misses the garden there - but no longer has a key for the house although his brothers 'allowed' him to collect a key from the estate agents to remove his possessions once he moved into his new flat
