5 month old buggy broke

im posting this for someone else, they bought a brand new buggy from addtions and the brake has broke within the last week, do they have any rights for a replacement or repair??

  • I would say that you expect it to last for more than 5 months, on the grounds of reasonable expectation & durability.
    Under the Sale of Goods act, any item less than 6 months old places the burden of proof on the retailer to show it is not an inherent fault.

    I would go back to the retailer. It is for them to decide if you receive a refund, or repair. Either way, this should be 'within a reasonable period of time', and 'without causing unnecessary inconvenience'. So weigh those up with how it may affect their ability to get out & about with the kids to decide expectations (i.e. could press for a loan buggy if a repair will take a while).

    the problem is its from additions direct (catalogue) and its not the persons account, they have bought it using a family members account, so it will be the family member dealing with the catalogue, i dont understand why people still do it that way, when you have problems like this its a bloody nightmare
  • it should not make a difference other than being a bit of a pain that the account holder has to sort out the issue

    i would phone/email the cat as another poster has mentioned as it is under 6 months old the cat has to prove that the fault was not a manufactures fault

    i would also contact the manufacturer of the pushchair too just to see what they say about the matter but really it is down to the cat to solve

  • I had a similar problem with a pushchair from Argos. The wheel broke off after 4 months. I phoned the manufacturer and they said to take it up with the retailer (as legally the onus is on them)and if I didn't have the receipt then take in my credit card statement. Most pushchairs have a 6 month guarantee and some have 12 months. I would get your family member to take it up with Additions direct as soon as possible.
