    You do not have to accept a defective phone.
    You have told us there is a brand new phone with you. I think we can reasonably assume that that phone is not defective.

    You are covered under The Sale of Goods Act.
    As has been said before, Nokia appear to have done all that is necessary under SOGA. They can replace or repair the phone as many times as they like... they do not have to refund you.

    It was never about liking or dis-liking any advice given but more about gaining other peoples opinions and then making an informed decision based on those views.
    I was just putting what I thought were the salient points, but thanks for your comments.

    Given they've now delivered a new phone, I would at least try it, and if the same defects occur, THEN push for a refund.
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    Even an N97 which is fully mechanically operational isn't great. Mine has all sorts of software issues. Mainly regarding running out of memory.

    And yes the firmware is the latest version.

  • Well I bit the bullet and opened the brand new one to see if the speakerphone was any better..........no, its the same,
    so phoned up a legal helpline and spoke to a solicitor who also advised me to go to the small claims court, so thats my job for today.
