Who is responsible for this missing part? What do I do next?

Hi All,
On saturday my van wouldn't start. I have breakdown insurance and the garage that came out to it said they couldn't fix it at the roadside so they would need to tow it. I agreed they could tow it back to theirs and give me a quote for the work on condition they agreed to tow it to my own mechanic in Monday if I didn't want them to go ahead with the work.
Yesterday they quoted me a stupid price for a part that needed replacing, so I asked them instead to tow it to my own mechanic, which they did.
Now my own mechanic tells me the part they took out (that they say needs replacing) is missing. He needs this part as he does not beleive that's the problem. The garage who towed my van are adamantly claiming they put the part in the van on teh passenger seat.
Who is responsible and what do I do now? The garage who towed my car have not spoken to my mechanic despite me asking them twice to call him, and now they are "at lunch" until 2.30pm. I need my van sorted ASAP.
What are my rights and who is responsible for this missing part? I want to call them and sound as though I know what I'm talking about.

What is this "part"?
Can you pick up a replacement for a fiver or so? If so, do that.0 -
If only it were that easy.
I'm kicking up a stink because the part is a motor control box that costs £120! The mechanic I trust (as opposed to the garage who recovered my car) doesn't beleive its this box that needs replacing, he thinks its a relay swith which costs £30, but he can't test the relay switch without a control box... see the proplem?0
