Capital one - Stalling!!!

Sent letter off on 29th Sept for statements, included cheque for £10. They cashed this on 13th Oct. Got a letter saying as i didnt sign my Letter(must have forgot) they are unable to provide me with info, they have confirmed that they have recieved cheque (which did have my signature on. What they are saying is i have to send them a copy of my signature and the 40day time limit doesnt start till they get this, but it has taken them close to a month to realise this. Can i state that this is unfair as they did have my signature on the cheque . Please advise any one :mad:

    Is the card still live?

    hi no its not live anymore!!! but surely they would have seen my signature on cheque....:o

    You could have been named after your mother or father so you should have signed it.

    EDIT: equally they could have sent the cheque back as the letter was unsigned.

    Dont understand opening comment!!!
    They do have a copy of my signature as I orginally sent them my 1st letter on 6th July but didnt enclose fee so they wrote to me requesting this which i sent with the letter they are saying had no signature on. Have written to them today and have told them that the 40days should run from the day they recieved my letter which i have proof of not when they decided to cash the chq or when they recieve my signature,:mad:

    You could be Job Bloggs jr.
    Your argument is not supported by the law which gives 40 days from the cashing of the cheque to when they have to supply the data since that is acknowledgement that they have sufficient information to proceed with the SAR.

    ok i understand will give it 40 days from when they cashed chq, not from when they recieve my signature. thanks :p

    Signature is a delay tactic with them , send all correspondence recorded delivery, the days count from the day of signature, you could also tell them no signature required as per se, and that as correspondence is addressed to you that it is acceptable for them, also use Anti Tampur signature or identify slight difference if you should give them one, that way you would know if it was lifted.
