My OH is in the process of Appealing a Court Judgment against him and has sent off the Application Notice today. He received an order from the Court saying he is in default and bayliffs can call round to collect up to the value of the default (£1500 ish)
what should he do when and if they call?
Can you refuse them entry? Will they barge in anyway? What would they take?
Im really worried as I have paid for most of the stuff in the house (and dont have all the receipts)
He has a good case for getting the judgment set aside but in the meantime I am petrified!!
any advice welcomed!

Refuse to open the door and tell them its being disputed. Provide them with evidence of this if you have it (shove a copy through the letterbox)Barclaycard 3800
Nothing to do but hibernate till spring

Hi Lou
The advice given is quite correct, and is it would appear that it's a County Court Bailiff acting then they are usually reasonable. A quick call to the Court would clarify the situation.0 -
Definately do not open the door. Once inside they do have the power to seize your OH's goods!
Have a read of this!0 -
"Bailiffs are well aware of their limited powers and may use a variety of different means to gain entry peaceably. They may attempt to walk in as soon as a door is opened. They may ask if they can use your telephone to check if an arrangement is satisfactory with their office. They may simply ask you if you would prefer to discuss matters inside. You do not have to go along with any of these methods."
Keep an eye out for these sneeky b******s0 -
certain debts/fine related to vehicle offences means they have the power repossess your car!"See you on the Other Side"0

:hello: darling
Hows your OH dealing with it. Chances are, wont he be the one at home, and you be at work? Just a thought. Whatever he does, tell him not to open the door.
If youve any doubt as to whether he will keep the door closed, or theres any one else that might open the door around at your place, then you could do worse than moving what youve got to someone elses house, if thats an option:beer: Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.
Theres no dollar sign on piece of mind
This Ive come to know...
So if you agree have a drink with me, raise your glasses for a toast :beer:0 -
Beware: Although the advice given is sound, there is one thing you should be aware of: bailiffs can (and do) enter your house without coming through the door. They can gain entry through an open window, for example. Beware this. It's 4 In The Morning :j0

And apparently they are allowed to break down inner doors! :eek:0 -
Phone the County Court, where the bailiffs are coming from ask for the Enforcement section, Bailiffs clerk. Make sure you get their full name and extension number. Tell them that you have filed an application to have the Judgement set aside. They should then notify the bailiffs to stay this action until the decision is made by the judge. The County Court bailiffs that I have worked with would never knock down doors or barge their way into your house, if you could prove that you have applied for a JTBSA. They would usually mark the warrant withthe information and check it out when they got back to the office. They have enough to do, without taking your stuff and then being told to give it all back when the Judgement is set aside.
Don't panic. Phone up in the morning and speak to the bailiffs clerk.0
