currys and a mobile BB deal

Hi guys

asking this on behalf of a friend who has no internet you'll understand why after this :P

long story but here goes......

he signed up for a vodafone tarrif from currys including a free laptop

after a few days noticed that the laptop randomly BSOD thinking it was something he had done re-installed windows and asked question about the problem on vodafone website! nothing worked.

returned to currys within the 14 days return period explaining to them the issue and that he wanted it sorting cuz he was worried about not being able to return it, infact he told them he wanted to cancel but they insisted that they would sort it out for him, they exchanged the dongle and informed him if that didnt work they would switch the laptop next time then if that didnt work cancel the contract.

didnt work returned it to currys around 2 weeks later, they took the laptop for repair, 27 days later just before he went on holiday he went to currys asking what was going on.. they said the laptop was still at the repair place and they took his mobile number and said they would call him next day.

No phone call he went on holiday... came back no phone calls 50 days after returning the laptop to currys so he went into the store again, spoke to a woman who found out for him that the laptop was classed as faulty but she could not speak to him about the matter but he could take the laptop if he wanted? confused why she said this he said no and asked to speak to someone else.. she said come back in 30 mins as the guy who knew about all this was on a break?

returned 30mins later guy said i have been trying to ring you on your mobile for weeks??? no voicemail unanswered calls on my mobile he replied anyway whats up with the laptop, its faulty we can give you a new one? he refused asked for the contract to be cancelled as he had lost close to 4 months worth of service (that he has not paid for)

the guys said no probs but it will take some time are you ok time wise to cancel it, as he was with the missus and had just got shopping in the car asked if he could come back the next day to do it.. the reply was yes of course mate no probs....

and now present day he could not get down to currys the next day he has been bogged down at work for a week so today he went in.. another guy sorry you can not cancel this because its 4 months old contract! explaining he had the fault from day 1 and that the reason its been so long is down to currys he still got a no we will not cancel?

what the hell can he do?

    If they said they'd swap the laptop the second time, why did he let them take it for repair?

    If the laptop was BSODing, that's rarely related to the dongle - he should have got the laptop replaced the first time...and I'm surprised the store didn't do that, as it's far more difficult and time-consuming to get the dongle swapped than the laptop - the store has to call up the network with the new IMEI and SIM numbers and wait for them to connect and cancel the old one.

    I would suggest that he talks to the person who was dealing with it about cancelling the contract. It's quite likely that if he talked to someone who had no knowledge of the issue, they'd say he wasn't able to cancel after four months.

    he tried to get the laptop swapped the second time but currys insisted that it HAD to go for repair? even though they had told him they would swap it, again they told him a fib obviously

    as for them swapping the dongle and not the laptop, sorry thats my fault i did not explain it correctly the dongle and the laptop conflicts somehow dunno how tbh ? basicly on wifi the laptops fine, put his sim into his sony w995 connect to laptop and its fine.. put the dongle from vodafone in and when it hits 3g+ speeds BSOD.. yes they did have to change the IMEI and SIM first time and was hassle he said

    he is going back in tomorrow to hopefully speak to the guy that said yes to the cancelling of the contract was just wondering if he legally can ask for the refund

    If he doesn't get anywhere today, he needs to send a recorded delivery letter to both the store and headquarters (telling the store a copy has been sent to headquarters) describing what happened, the visits he's made (with dates), and that he wants the contract cancelling.

    He should then go on to say that if this is not sorted within 14 days of receipt of the letter, he will be starting small claims court procedure against them to claim back all lost money.

    right went back today and was told again no he can not cancel original guy not in, he kicked up a fuss stating that the item was not fit etc etc and its been that way since day one...

    guy said that he would pass the matter on to the original guy who said yes to cancelling as "he should not of said it" as the contract is now 4 months old... same old story.. he photo copied the recipt and took his mobile number down and was told that he would be rang the next day regarding the matter

    they keep harping on about my mate would have to prove he has not used the mobile bb??? he has explained countless times that they have had the dongle and sim all along since it went it for repair

    Whether your mate likes it or not, he certainly isn't entitled to a refund.

    Also, i cannot think of one instance where a dongle would BSOD a system after hitting a certain speed.

    More to this story i'm afraid.

    well i hate to burst ur bubble but it has been confrimed by currys as faulty for that exact reason? so dunno what your trying to say the bundle was reported faulty within the 14 days return period its currys fault problem its took this long to clarify it for him

    right! he is not happy now

    they had his mobile number but have failed to phone him at all? they have the laptop, dongle and sim ... vodafone are sending letters demanding money because he has not paid his bill ( like i said thing was not working from day one and he returned it before the first bill )

    what is his best possible solution to this? he spoke to vodafone they informed him that if the laptop/dongle is faulty that he has to take that matter up with currys, the woman apparently understood that he didnt want to pay the bill and put a note on the system?

    Find out when the person who originally dealt with it is in, and go in on that day and sort it with them.
