Not my debt but they've put my name on it!

Hi,

I have a current account with Vertbaudet. However, there was an account at my old address in my ex partners name. I no longer have anything to do with his and we are not financially associated. I called them up the other day to pay my account because i could not do it online and the gentleman told me it was because the current tenants had written to them saying the debt was mine!

How they got the details without openning my ex's mail (which is illegal) or came to the conclusion that it was mine is beyond me.

Aynway. I now have a statement from them which now has my name on it and my ex's old account number. This is completely out of order as far as i am concerned. How can i be held responsible for soones elses debt. Does anyone know the legal position on this?

They have told me i have to write in and explain?

what is there to explain?

    So there are two accounts, pay your own and tell them that the other one isn't yours and you are having nothing to do with it. They can't just change names on accounts and verbaudet should have a record of whose name the account was in. Why would they need to ask the new tennants totaly mad!

    Also i remember people asking for a signed copy of the account contract or debt, if they cant provide this the debt gets written off.

    Id ring up to say it isnt yours, if they are idiots then request a signed contract for this account, when they dont have it then the egg will be on their faces :D

    I have written to them telling them i refuse to accept a debt that is not mine.

    I also told them to refer to the signed credit agreement to confirm who is legally responsible.

    Funny they sent me a statement this morning with the account showing as closed with a zero balance then re-opened with a balance of nearly £300. THought they could try their luck. I bet some people actually pay, which is the sad thing.

    Also remember that if given a letter saying you owe money from a debt that isnt yours just dont reply to the letters at all as then they cant prove that the letter went to the correct person and you didnt acknowledge the debt, (Citizens Advice Words)not mine, but it does work :)

    Thats what CAB would do.You can either do it yourself or get your local CAb to do it for you

    Even though you say you have no financial association with your ex I would get your statutory credit reports from Experian AND Equifax. I only ever got mine from Equifax but one day ordered the Experian one and found out that on that one I was financially associated to my ex! God knows why either. The only thing I can think of was she was on my car insurance! :confused:
