Really glad I saw this thread: have also had two copies of that very same letter from Mercers (despite the post strikes...lol).
I did ring Mercers last Tuesday and was promised a 14 day stop on further action. Since then they have rung at least daily and sent a further letter....
I appreciate that I am the party at fault here but I have consistently made token payments to Barclaycard and kept them fully appraised of my situation and the actions I am taking to deal with my debt situation.... and... Barclaycard are actually among the smallest of my debts and no one else has passed debts on to doorstep collections yet.
Reckon I would be OK ignoring Mercers until the 14 days are up? Are they part of Barclaycard? I notice they have the same return address postcode?
Thanks!0 -
As far as I remember, yes Mercers are part of Barclays but I am sure someone will tell me if I am wrong.BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0

Mercers are part of Barclaycrap, but they are not as bad as MBNA.
Be careful when calling Mercers / Barclaycard from your normal number as they use call scanning software that stores your landline / mobile number to send you junk texts / calls etc.
Make sure you withold your number when calling and don't take any crap.
I record all my mobile calls and tell them so- I have even got them to put it on my notes.
Another trick is not getting my letters (even faxes with reciepts !). I sent all my debtors a SOA and most were ok, Barclaycrap were amongst the worst.
I bought a 070 (personal number) and diverted it to a spare mobile (that they don't have) and they then pay 50p per minute to call me. This also frees up my real phones.
Change your number and don't give them the new one.
I have also removed any rights of implied access by letter and in several recorded calls
Remeber, remain calm. Don't make them control the call.
Keep in control at all times
If you want a laugh give your correct name and forget your password or other memorable information- the can't go through data protection and have to terminate the call

They're probably just 5 people sat in a corner in Barclays' offices.
EDIT: Ah, skintandfat (I feel bad typing that) got there first. Yes, MBNA were far more bullying, but after I hang up on them a couple of times for being completely out of line and then logged a complaint they stopped calling. Mercers are still at it !!!!!!.
EDIT again: Ah yeah, if I did pick up the phone thinking it was someone else I said I wasn't in when they asked for me.BR 22/10/2009 ED 08/07/20100 -
I'm so glad I saw this as I have had the same from Mercers (who are actually Barclays) and now another company called Power2Contact who are actually CSL in disguise that they have passed my account on to. I have been trying to save up to go bankrupt too, but I'm on benefits so it's taking a while, and have explained my situation to everyone. Barclays, Mercers, CSL etc all have been told til I'm puce but they still feel the need to call me at least 6+ times a day and call my mobile too. I found out my mobile has a reject list though and this is proving very handy. Every time they call I just add the number to it. I have to have all my phones on silent too as the calls start at 8.30 even on saturdays and sundays. When I called the Power2Contact people today they were very rude and just said that someone would call round to my address.. When I asked them why as I can't pull 9K out of a hat and hand it to them she just repeated that I hadn't paid therefore someone would call. I just ended up saying ok whatever, but they won't get in or get a conversation with me. Annoys me how rude they are, I mean I'm not deliberately not paying the debts, just not able to and I don't think it's called for.
I was a bit worried too that they might go and harass my neighbours, with the knocking on the wrong door thing, or just plain asking them about me, but I'll deal with it when/if it happens I guess.0 -
I love this lot
They occasionally send me letters, and did send someone to the door. Pity i wasnt in
But for me Capital One are by far the worst!! Also my smallest creditor which seems odd to me.

If they do not.....then surely the CCJ must be held-over, if it comes to the notice of the Debtor that an incorrect address was submitted by the creditor....wilfully?
In other words, if the Debtor can prove to the court they have lived where they do for a reasonable length of time, and that the creditor would have been aware of that fact..[the letters demanding payment??]You would think so, but not always, depends on the court and judge, the creditor normaly claims it was a simple error, and the court accepts it
Plus, how would the bailiff know where to find the defaulter, if the address submitted by the creditor was profoundly incorrect?strangely, they suddenly remember where you live once they get the court order
I think, within reason, the Courts would give everybody concerned an opportunity to have their input?thats how it is supposed to be, but to be honest the whole system is geared against it these days, as you can not get advice in fourteen days as it takes longer to get an appointmant at CAB for example these days
I believe the debtor has about two weeks to respond?
and the CCJ can be overturned or reduced subsequent to imposition, by the debtor submitting evidence to the court? Again, yes in theory, but why do some courts award a ridiculous re-payment, even if they have a SOA of the debtor in front ofthem
After all, the Court is the fair arbiter? Hmmm debateable, not in many cases i have followed, i wont go as far as saying they are not, just very inconsistant
But I can see why professional creditors would like us debtors to be ignorant, and fearful of contact with the courts.....wouldn't do if we all adopted a ''bring it on'' attitude?
Yep they would, and dont like it when your not;):pThats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all ………….

Often the smaller ones are.
Maybe they think they need to shout louder to be heard?Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

As you know, that is certainly true of all my cases, in fact it cost them more to lose in court than the debt was worth to try to be heard:pThats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all ………….
