Pssst!! Thats only one side, the bumph on the back is important as well.

Just to echo PTP's post, OP you need to post the bumpf on the back of the PCN as well.

It may look like standard small-print but sometimes some experts can see a get-out for you in wrong wording or something. You need a few straws to clutch at!

Apart from that I wish you luck, you'll need it IMHO. AFAIK, double-yellows apply to the whole width of any street, side-to-side including pavement (but not including land privately owned as car-parking areas for hotels, retailers etc.).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

That is pretty disappointing :-(. It has nothing behind, just a standart wording where and how to pay.
  • It may look to be standard to you, but lots of pcn's have been found to be invalid because the wording is misleading and incorrect. Its up to you.

The lines look very feint on the block-paving area of the road [which looks to be where the car would be judged as being ie its besdie the block paving as opposed to the tarmac bit.].....not sure how feing needs to be beofre you have a chance.

Any chance that the block paving bit is actually private land eg an access area for the back of the shops??. If it's private you are in luck.

I fear you have missed the point - we asked you to post a scan of it...we know it looks like standard blurb but it isn't!

There was a very similar thread to this not so long ago: http://forums.moneysavingexpert.com/showthread.html?t=2019127
Different place, but very similar circumstances:

Sorry to burst your bubble, but waiting restrictions indicated by yellow lines apply to the carriageway, pavement and verge as per the traffic regulation order. See the text at the top of page 2 of this document: http://www.direct.gov.uk/prod_consum_dg/groups/dg_digitalassets/@dg/@en/documents/digitalasset/dg_070563.pdf

Unless you can prove that the entire area was private property (which is unlikely as there appears to be a footpath between the cars and the building) then there's no doubt that you have committed an offence. The offence is failing to comply with a traffic regulation order. PCNs issued to this end usualy state code 01: Parking in a restricted street during prescribed hours. The prescribed hours are 24 hours a day, 7 days a week in this case. "in a restricted street" means anywhere on that side of the carriageway up to the building line.

Your only hope now is if NeilB or someone similarly qualified can find a technicality in the PCN.

There is definitely a difference between the two pictures. The first shows the car completely on the footpath quite close to the kerb edge. Now imagine someone trying to push a pram or wheelchair around the back of the car without going into the road. Do you think it would be possible? Now look at the second picture of the silver car parked within the private property boundary. Can a pram / pushchair be pushed around the car over the tarmac footpath now? The difference is clear to me and the second car isn't on the public highway.
  • Unless he gets to see the back of the pcn he won't be able to properly help.
