Changing the Law regarding a Commital to Prison Order

Is it just me or should the law be changed for commital to prison proceedings, all well and good that the nrp who has chosen not to pay(like my ex) finally gets to court but why can't a judge order him to pay the current maintanence aswell as £x off the liability order?

Seems we are wasting alot of time and money by taking the nrp to court for each LO for commital to prison when if the judge ordered the above would stop a vicious circle, don't you think.

My ex was ordered to provide audited accounts for 2008-2009 so the judge could make a decision but paid a lump sum on the court steps and made an arrangement with the CSA representative for the outstanding amount which he has failed to keep.:mad: So I now have to go back to court for the same LO? Crazy or what why did the CSA not just go into court and rubber stamp the agreement so he would have faced consequences if he did not keep to the arrangement? Another CSA fiasco!!

So once again he has months of not paying until it reaches court again.

Anybody agree?

    In spades Sarah, he's at court so lets see the job through to the end he's there because he cannot be trusted in the first place so seeing as its taken that long to get it to court....... as the late great Magnus Magnusson would have said, 'i've started so i'll finish'. so if its reached court the job should be finished.

    letting him off on the steps even I can see through that and I believe anything:o most of the time. In time they may stop accepting payments in this way.

    You have to remember that the CSA dont like Court Orders like that, because if they then make a mess of it, they are stuck with it and cant go back to Court, because the Judge will throw them out! We all here know the CSA dont make a mess of any case don't we, and they never get it wrong, do they!!!!

    Its just so frustrating that nothing can be done to make him pay regularly(he's now self employed to avoid the paying DEO that was in place) the attachment to the bank account won't work cos he'll stop using it like he did when they took money direct from his bank account last year.

    He's now threaten to sell his house to his 'friend' and told me it will still be his and he then can't get the house sold from under him. CSA can do nothing even though he is depriving himself of an asset to avoid payments.

    He is also saying he isn't working when I see him in his work clothes, so now he is ill and is apply for sickness benefit. All a joke but the burden is on me to prove otherwise as the CSA do nothing. Time that could be well spent with my children!!

    A little point here but don't you mean 'our' children rather than 'my' children as he allegedly had something to do with them in the first place, or are you claiming that they are nothing to do with him now?

    You've pinched DUTRs line :p

    I agree with your post, but it is not always possible to put our children, eg my children are not all our children (not all are nrps).

    He is the father of one of my children yet continues to deny that, has demanded DNA tests through CSA yet when I say ok he never follows through. Surprise surprise! He would not be able to justify his actions to his wife when he is proven to be the father, he has refused the contact offered, never bought her anything no clothes, toys, christmas, birthday or Easter presents since we split. He may be her biological father but he is no 'dad' to her!!

    Anyone can be a father it takes someone special to be a dad...........there are lots and lots of fathers in this world, unfortunately the number of dads is less!

    To request a DNA test is not denying paternity, if the couple were not married and the male's name is not on the BC then a test can be requested, although folk say these things don't matter in reality they do! After all the child is not some dirty little secret :o
    Anyways we are not here to discuss that aspect.

    being a dad or father is not status desired by all, (you get similar bullying from JWs assuming everybody wants to live forever :eek: )
