    update-
    i tired my luck and they said 'copyright laws' so only exchange for the same again.

    unfortunately (not the ironic tone) they were out so allowed an exchange for a game of equivalent value.

    thanks for your thoughts. i see it is not straightforward. but the thing was useless- not just bad but unplayable.

    Since when do "copyright laws" override the Sale of Goods Act?

    Because of software writing? Do you mean poor coding?

    You were lucky to get a replacement game (I hope you read reviews and got something GOOD i.e Okami or something similar, rather than another fitness game). The difficult thing with software is that its quality is subjective. You bought a game that wasn't designed well, but that doesn't mean that it's 'not fit for purpose' just like if you bought a CD of your favourite band to find the new album's crap.

    If the disk itself was faulty, however, that's another matter.

    Did you try it in another wii to see if your wii was faulty rather than the game?

    Because it's very easy to buy a game, copy it, then return it for another game to copy and so on.

    That's why most places won't take a game back if the seal has been opened.
