bank charges after being ill causing finacial hardship what should i do next please

    thanks for the advice i will also demand that they do not use my dla money as income because as you say dla is for care and mobility not incomei have today recieved a standard letter from lloyds saying that they believe the currant account fees and charges are clear and represent a fair charge for a banking serviec that is valued by our customers. however lloyds tsb along with other major uk banks has now become involves in legal proceedings with the office of fair trading in relation to unauthorised over draft charges. we believe these proceeding will resolve the legal issues regarding the fairnss and legality of these chargess
    where we recieve complaints about these charges we would usually try t resolve them through our internal complaints process as quickly as possible , however until the determination of the the legal issues in the above proceedings we have asked the FSA yo suspend the normal timetable for deling with bank charges complains which relate to unauthorised overdraft charges the fsa has agreed to theis request subject to the conditions that protect your rights
    what will happend next will depend on teh courts we do not know how long the case will take- we have promised to proceed as quickly as possible but inevitably given the inportance and complexity of the issues

    however if you decide to make a compalint we can sssure you that the deails of it will be registered and once the legal proceeding with the oft are concluded we will resolve your complaint as quickly as possible if at the that stage you do not agree with our response you will of course ve able to refer you case to the finacial ombudman service FOS or the courts
    it would appear from this that they are saying they will put my claim in a que untill after the court case which could take a couple of years but i thought i had read on the website that where charges we making finacial hardship that the FSA had said that they had to resolve these case first and not leave them in the que that a person had to have engough money to live on and charges should not apply where they will cause finacial hardship it there a template letteer to send to them on this they have given a a list of all the charges that they have charged me over the years and it seems quite high can i also claim back the account charge of £17.00 per month or is just the unauthorised over draft charges

  • DLA is counted for income purposes.
    You have to prove that the bank charges are making the current financial hardship worse ie that the charges are eating into your budget meaning you cannot afford to pay priority debt arrears(mortgage or rent, council tax, utilities). Even under financial hardship the bank does not have to refund even 1p under financial hardship.
