Had eviction letter - Please help!!

    Which deposit scheme has been used? You say you "believe" that the deposit was registered - did you make your own checks at each of the three? ( DPS, TDS, mydeposits - google them and get a definite yes/no)

    mydeposits - I phoned them and confirmed it is in that scheme.

    in that case you and he have to come to an agreement as to how much is returned to you. HE holds the money in his bank account - quite legitimately - but if he does not return it, i think you can appeal to mydeposits as he will have had to pay for an insurance policy to cover this eventuality.

    If you are in the fixed term of your contract then your landlord could argue that you have breached the contract by leaving early and you should pay the rent upto the end of the fixed term.

    Hopefully he has agreed to you leaving early, but it is a risk.

  • Right, lets lay out the facts:

    I had a letter saying I would be evicted on the 26th November. It came to the 24th November and there was no letter saying I wouldn't be evicted so I moved out.

    I want my deposit back. I spoke to the deposit scheme people and they said he should return it in 10 days. He says he will do it over the next 6 weeks in installments.

    He is now getting funny saying he will deduct money becuase the stair rail was broken (it was broken when i moved in) and because the oven wasn't immaculately clean (we were in a rush to get out) and the shower rail wasnt up(it has never been up). He never did an inventory when we moved in or out.

    I want to get this bloke legally in the pocket where it will hurt him the most.

    We moved in in February and paid him a deposit of £900. I was speaking to the deposit scheme people yesterday and they told me he should have notified me of the deposit scheme & given me the necessary paperwork within 14 days of me paying the deposit. However he never did notify me of any such scheme or get me to sign any forms until September. I have been told that by doing this he broke the law and if I want to I could take him to the small claims court for compensation.

    Does anyone know the likelihood of me getting any compensation at all?

    Basically I want to legally cause him as much as grief and hassle as I can in return of the stress that he has caused me and my pregnant wife other the last 2 months.
