6 CCA letters ready to go-- few questions, then our progress

Have sat down with the wife and gone through our standing orders setup with DCA's (sorted through CAB a few years ago)

we have

lowell finacial x 2 -- store card and barclay card
Capquest x 2 --Halifax credit cards
Mackensie hall-- Studio account
Robinson way -- Next

so before i send the letters off i want to know will this stir up a hornets nest with the DCA's, will they then come after us for the money quicker, ie not accept the payment plans we have in place anymore

They have 14 days to produce them, if not thats it we can stop paying??

if they do produce them then we can have them looked over for enforceability,and also the 3 credit cards and 1 store card can also be looked at for mis sold ppi ??

Are any of the above especially tricky to deal with??

Anything else we need to know/do ??

    If these debts are with DCAs, you probably already have a default. In the absence of the CCA, nothing else they can do.

    What we usually see here is one very curt attempt to play rough. Then either:

    1. The CCA turns up and you continue paying.
    2. They get stroppy- which means the CCA probably does not exist. At that point, you need to hold your cool.
    If you've have not made a mistake, you've made nothing

    That would be 14 working days and you should only do this for agreements made before 6th April 2007.

    They may come up with reproductions rather than the original signed CCA, which would mean that you may need to send a SAR to the original creditor, but we can look at that later.

    Definately look into whether the PPI was missold and don't forget to do everything in writing - don't phone them.

    we can ride out a bit of rough stuff so thats not a problem


    will get them off monday to miss this latest strike, will be sending p/o for the £1, do i just put the company name on these?

    I suggest you tackle one Creditor / DCA at a time, the CCA process is a long and drawn out process, creditors / DCAs will do what they can to confuse you, tackling one at a time will allow you to remain in control.

    I did three CCA requests 3 years nearly three years ago . Two have shut up and the other sends settlement offers now and then .

    I've seen various posts here advising that the postal order should be left blank (in the payee section). However, I've just had mine returned by Lloyds who claim they cannot accept it if their name isn't on it.

    I don't believe them to be honest - surely they can just write the name on it?

    If I were you I'd send them blank because you nver quite know which department will be "cashing" the PO.

  • right all 6 sent recorded today so by my reckoning if i haven't heard by the 19th, then i can cancel the payment, correct??
