You’re right. Capital One do like to contradict themselves. I recall being told in 2004 I would have to take out PPI cover, in order to get a credit card. At first they refused to refund anything. I filed a complaint with the FOS then received my SAR late September, which included a letter dated 31st July in which Cap One offered me a partial settlement, although I did not receive their original letter, making such offer. Now Capital One were adamant they had not mis-sold me PPI then they make an offer: roughly half the total amount. Admitting guilt I think. I wrote back to them, early October ’09 telling them how much I would accept and told them I did not receive their original letter, dated 31st July ’09.

I believe you and I took out cards in the same year and I got exactly the same things as you and this is currently with the Ombudsman sine March this year. They went as far as to tell them that I had agreed to accept the offer and they couldn't understand why I was taking it further.

I seem to be in the same boat but received my credit card in 2002. I clearly remember the telephone conversation and felt if I didn't take the PPI they were offering I wouldn't get the credit card.
Do you guys think I have a case??
The reason why I took the credit card in the first place was to improve my credit rating but as of today I'm looking to transfer my balance to another credit card. I am on a very high APR and Captial One seem to be one of the most arrogant companies out there.

You can only go back 6 years for re-claiming PPI. I think there may have been some cases where people have gone back a bit further. Download the PPI template letter off this website and go for it.
I personally feel like sending Cap One a chaser letter but fear it might get lost in the post due to the postal strike.0 -

They do say up to the last 6 years, but yet again its true that you can also be successful in reclaiming going back even further, this year I was successful through the FOS with my credit card ppi, that went back as far as 2001, my hubbys was upheld as well for the same year.
Many have been successful from claiming back from the 1990's as well, maybe mid 1990's and onwards.

I know re: UTCCR's Britain was told to implement the UTCCR's in 1995 but we did not do so until 1996? In all fairness those reclaiming bank charges, should be able to go back to at least 1996 not July 2001.0 -
If this is for claiming back PPI and not bank charges then its not to do with UTCCR its to do with being within FOS jurisdiction. This would mean that prior to the FSA regulation of insurance in Jan 05 the firm must have been a member of the GISC (general insurance standards council) or another one is the banks would have been under the old banking ombudsman prior to the FOS. Other than that FOS would have no jurisdiction for misselling.Di3004, do you know what wording they may have used in their letters, to go back further than 6 years? Thanks.
