    Pinksnapdragon82 that £25 per month whilst in arrears is on the bottom of my letter stating they have possession of the house now. They have not got a clue.

  • Can I please get something clarified? When going bankrupt you state all of your unsecured debts and at that stage you can enter your house repossession if in arrears? Is that correct? If so, how do you know how much the total outstanding would be? And do you stop paying the mortgage, get it repo'd and then go br or are u better going br 1st? Thanks

    Some one will have the exact info you require but other than saying to contact the debt charities who will make sure you know every thing entailed with bankruptcy I wanted to say something else.

    When you go bankrupt if your house is valued and is in equity of £1000 or more you will lose the house as it is an asset. If it is in neg equity then you maybe able to keep it but you have to keep up with repayments.

    It depends on how much outstanding is on the mortgage (statements) and the valuations. We went br first then sorted out the house once we had somewhere to live. We did stop paying the mortgage the month before we went br.

    I never needed to say my mortgage was in arrears, that's kind of between you and mortgage company, The OR has an interest in the house when it's sold, which ever way that is has no effect on br as such.
  • Right ok, I don't want to keep the house though as it's in joint names with my ex fiance who no longer pays towards it, I don't live in it either and am living rent free thus far at my boyfriend's house, but this situation can't continue - it's not fair on him let alone me. So would u stop paying the mortgage, get it repo'd and then go BR or go BR 1st. There is £8k of equity in the house.
