Selling Promos

Hi
I sold The Independants German Cd and book because I didn't want and I thought someone else might. It went for less than the price of the 2 papers. The buyer is now saying he didn't know it was a promo. I have given him a full refund, but that is not enough he is shouting at me ( in capitals) inferring that I have invoiced hom again and threatening to report me to ebay and The Independant ( OHH, I'm scared). I did not mention that it was a promo - hands up- an oversight. But I did put THe Independant and there were pictures It went for 1.55 ! Have I breached ebay rules? Why do I keep getting these unpleasant individuals.

Personally as it was only such a small amount and you did forget to mention it was a promo I would just refund and be done with it.
Most promos given away with newspapers do actually say somewhere on them that they are not for resale, by coincidence I have all of the Sunday Times Disney storyteller CDs in front of me and they say on the back 'promotional use only. Not for resale'.
It is unlikely that either ebay or the Independent will do anything, but for the sake of a neg just refund and apologise that your listing was incomplete.

I'd suggest you just keep saying sorry until he gets bored. I can't believe fleabay will do anything about it, particularly as you've refunded quickly.
Just a point in general:
If you are selling these giveaways, it is important to mention that they are promo's because they rarely have subtitles, and these can be important for some people who would find a disk without sub-titles useless.0 -
Sorry I missed the bit about the refund...in that case I think I would just agree with moglex and say sorry until he gets bored and goes away.

They don't say not for resale on them. I have said sorry and fully refunded as it didn't seem worth it, but that isn't enough for him.I am sure he is going to neg me should I point out that it doesn't say not for resale and that I did mention the Independent in the blurb.

If you examine the item closely you will find that it does not say item is not for resale. If you look at this website http://www.hoddereducation.co.uk/Titles.aspx?isbn=0340867655 the item is worth 14.99. I do not wish to inflame the situation as you obviously feel that I did something wrong, but in all honesty I don't think I did - I could have spelt it out that it was a promo, but I felt that 'The Independent' was enough. This item can be bought as you can see for quite a considerable sum more than was paid. I consider myself a reputable seller and as a result offered you a no quibble refund. I will not be invoicing you again. There are lots of these items for sale on ebay and other freebies from papers- most of which are not for resale.

I really don't think you've done anything wrong, but, sadly, ebay nutters are a fact of life.
It's a shame to loose a 100% +ve feedback, but look at it this way:
The ebay nutters are often so anal they probably only deal with people who have 100% feedback, so by getting a neg you may save yourself the hassle of dealing with people for whom nothing will ever be good enough.
Also, remember that if he does neg you, you can put a simple, calm explanation, e.g. "DVD was from Independant, and this was clearly stated in the auction" underneath, so anyone who is actually worried about the neg to look will see it is unwarranted.0 -
I have 99.9 % have come across a nutter before! It is just 2 in as many months - I am getting more than my fair share and my major competitor doesn't seem to be getting them - I wonder where I am going wrong!0

Just a statistical anomally. Nothing to worry about unless you only have a small number of feedbacks when it's really unfair and people might take notice.
If I wanted to buy from someone and they had less than 99% I'd always look and see the nature of the negs before rejecting them as a seller. (I'd also have a look at the feedback of the person doing the negging to see if I could spot the nutter giveaway signs).
That's why it's very important to put calm, polite and factual explanations under the nutters negs.0
