car deposit is it legally binding

my son paid a deposit to a private seller for a car, the seller has now changed his mind, the seller signed a receipt for this is it legally binding

  • If they are giving him his money back take it & move on.

    You could in theory try and force them to sell it to you but the hassles & costs might be too much bother.

    Did they give a reason? In the past few years i have learned anything can happen.

    In the same situation i would be gutted but glad i was getting my money back.

    I disagree with Photo Stylus in principal. A contract has been struck therefore the car is now your son's.

    However, I agree in practice.......... have you got the "will" to fight this?
  • it will cost you to fight it, not worth the agro

    besides whilst you are fighting it they are not going to be to careful with the car, which you would then probably want to reject anyway

    thanks for advice i spoke with trading standards today, the seller did make a binding contract, he should cover all costs incured by the buyer, deposit, insurance, travel, car inspection ect, this is done by going through the small claims court,

    for a small claim you need an ADDRESS, for anyone else paying deposits!

    in our case the seller is imigrating on tue and we are in the middle of a postal strike, although with address they would persue to oz,

    also found out in certain circumstances you can pay the DLA for an address from car reg, would take a month

    so we agreed on our deposit back plus £100

    personally we hope he and his wife get bitten in oz

    You were extremely lucky to get anything back, let alone £100 and the deposit.

    Once he's gone to Oz, it would be extremely difficult for you to get any money out of him. Trying would just incur you in more expense.

    I hope he paid you in cash ... ;)


    Edit: Btw, whats he planning on doing with the car. He's not taking that with him is he?

  • I bet he's taken deposits from a load of people then refunded them all with cheques that will probably bounce.
