Next Online Credit Account - Legal Advice Please

The NEXT scam is still the same (notwithstandinmg the T&Cs) in 2011. The page still gives the impression that an online account will be created only if you order the catalogue, and that it won't if you don't. Preceeding that, of course, is the assumption by everyone - old hands and newbies alike - that you can order from NEXT and pay with your credit card like 99.9% of other websites. Except you can't (without creating an account or making a separate phone call)!
Amazing that this deception has been going on since 2006 at least, and not even ended after it was highlighted by the authorities and BBC in 2009.0 -

So the promise of change in early 2010 was a hollow one then.
I think it's time the BBC and Which! revisited this.
It's a dirty practice illegal or not. Thanks all for your messages, it's very helpful to have a history on something like this.0 -
I always thought I was registered on MSE and tried to post on this. But after trying to put the first post, I realised I was only receiving Money Tips and was not a member.
So I registered today to say this-
-- I appreciate the OP for taking time and sharing his experience
-- I had the same cheat registration on Next online where their website cheats you into account registration.
-- unfortunately I didnt try any more than a call and no legal actions so unable to suggest anything positive except verifying OP's experience
After realising that I was duped into opening an account through back door and registering a search on my credit history for an unwarranted credit limit, I called Next to cancel the account and remove credit search - neither happened.
But I did what I could i.e. to return everything as return is free and never bought again from there.0 -
Next is a very unproffesional company in the way they do business anyhow. Best off just closing the account you didn't want, and not using them. If everyone did this, we'd be free of them in no time.0

It is 2012 and I can confirm that Next have changed nothing. I found this thread after I went to purchase a top on Next.co.uk. After I set up what I thought was a standard account (similar to other sites). I went through and was told I had been rejected for credit and had to pay by card. I was very confused, at no point had I tried to apply for credit - I just wanted to pay by debit card.
I googled to see if anyone else had had this happen and was shocked to see they had. I have sent a complaint via email to next. I have worked hard to improve my credit rating and now have a black mark against me for something I didn't apply for. With most credit agreements they require an account number and sort code as well as your agreement to go ahead with the credit check - why is Next exempt from this?
Does this not fall into irresponsible lending, for those who are accepted? Giving them the temptation to spend more than they have because of surprise credit?
I only went online after getting a code for £10 off from in store.
The adverts for PPI say "ppi was mis-sold if you didn't want, need or ask for PPI". Can it not be argued that Next are doing the same? I am sure that many people did not want, need or ask for a next credit account. Does anyone know how this can be taken to the FOS?0
