looking for advice regarding parking fine
drinksy
I wonder if anyone can enlighten me on the law if any regarding the parking ticket i have just received in the post for allegedly parking in Icelands car park without a valid ticket.
please let me explain in brief:
I parked in an Iceland car park, I purchased a ticket which luckily i still have in my posession, and i left the car park within the time limit on ticket, so there should be no probm, so i thought. The parking ticket i received stated that i did not have a valid ticket for the period i stayed in the car park. I sent a letter to the Excel parking, with a copy of my ticket, who replied and told me that as i did not place the full reg number on the ticket it is not valid, so i must pay the fine. They continued further by explaining that i was in contrevention of the terms and conditions of the car park blah blah.
In my defence:
I have the original parking ticket, with 58 on the ticket this is the number i imputted which is part of my reg, luckily I found the original ticket as i hord parking tickets in my car. (as all the councils car parking machines just require the numbers from the reg, thats why i automatically place the numbers in the machine only)
The serial number on the ticket proves that it was purchased 2 minutes after i entered the car park, and expired 2 minutes after i left the carpark, CCTV footage proves this, as they have send me pictures of me entering and exiting within the ticket times.
There is no way that the original ticket could be a fake, or from another vehicles from the car park, as we are talking a month ago when the alleged offence occurred to me receiving the fine plus it has my reg numbers on it the ticket of 58. There would be more chance of me winning the lottery than me finding or obtaining a parking ticket within the time limits i visited the car park.
I feel really angry about this ticket, and there is no way i would pay it, however can anyone give me any advise, as i have no idea on any parking laws if indeed there are any.
Any advice would be appreciated.
Thanks
Peter

Any independent person, when presented with the evidence you have, would agree that you acted in good faith, did indeed pay for a ticket and contravened a technicality. Given the likelihood of you taking another car's similarly numbered ticket within the time limits that have been proved by CCTV, it's highly unlikely that the technicality would be seen to change the "damages" they will try to claim.
The "damages" that you owe them is precisely zero. Even if they take you to court, simply produce the evidence that you have which will show that you owe them nothing and that their demands for further charges are grossly unreasonable.
You have already been reasonable and tried to negotiate with them, but they are being unreasonable in their responses. There is no further need to contact them again and you have already exhausted all reasonable efforts. Ignore all future correspondence and if - and it's a whopping great IF - they submit a court claim, let them. You have nothing to fear.0 -
Please ignore them and all their rubbishy threatening letters. But under NO circumstances let Excel know who was driving the car - I assume the CCTV pic doesn't show the driver clearly? I do hope your letter didn't suggest who the driver was?
Unfortunately Excel are one PPC who have picked on victims and even taken a few to Court when they know who the driver was. It's only fair to tell you that, but also fair to say that if this was to happen you could obtain a secure defence from forums such as pepipoo.com.
So don't worry about it, Excel would not win a properly defended case and you have the evidence to show you paid, as you have already told them.
There are no laws that allow them to charge this amount, they just make it up. It's NOT a fine but they will send you letters alleging a debt and threatening court action, letters with pretty colours looking as if they are from a Solicitor, etc.
Do not worry but do not contact them again even when you get the pretend Solicitors' letters. This is a scam just the same as Nigerian email scams.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

As everyone else says, ignore them completely, they are scam artists.
stick anything they send you behind the clock on the mantlepiece. Smile smugly at it every day.
They will eventually give up.make the most of it, we are only here for the weekend.
and we will never, ever return.0
