Returning a Net Book - HELP!

Hello!
In June I purchased a Net book from Curry's. I paid the £179.99 using my Maestro/Switch card.
Since then it broke and it got sent back to the makers of the Net book (HP) They fixed it and sent it back.
Now it has broken again which seems to be a different fault.
I only use the Net book occasionally and mostly use it to store a few pictures on etc.
I am not pleased I have a product which has broken twice since I purchased it in June.
I would like a refund for this product, As it stands I cannot use the Net book at all. As far as I am concerned it is not fit for use.
Only problem is when I took it back to the shop the guy serving me says I will not get a refund, I have to get it sent off to HP to be fixed again or nothing.
I just spoke to Curry's customer Support who said I would only get a refund if the Net book broke 3 times with the same fault. (I think this new fault is a different fault to the first one)
Am I entitled to any kind of a refund? I cannot use the product currently, It's the second time it's broke down sinse I bought it in June. I am unhappy with it and would like my money back.
I have a manager phoning me back in an hour, But apparently they will only tell me what I was told by the guy I just spoke to at Customer Support.
(This was earlier, I missed the phone call as I had to pop out but I will be phoning them again Tomorrow)

Retailer decides the course of action ultimately according to SOGA: refund, replacement or repair.
Store policy may offer the consumer the choice, the reference to 3 repairs sounds like local policy.0 -
A repair fixed the first fault, it should fix the second as well. And then you'll have a working netbook.

Hey mate slightly different item but similar circumstances......
Same thing I got mobile phone from orange, kept shutting down returned it to them told me had to have same fault 3 times before they would replace......
got the second one same fault retuned it to them, contacted consumer direct, advised that didnt have to accept a further repair on said item, it may be their policy however SOGA> that. I got a replacment phone of my choice after following the info from consumer direct.
Again its different being that I think you are pursueing the refund angle so not 100% how that going to go for you Consumer direct are always good for advise I have always found them to be ok.
Or someone here will come along thats probably had the same scenario and explain how it worked out for them.
All the best but i think with them stating its a different fault you might be stuck with them having to repair this as its not the same issue....0
