Change of Employer and Building.

I wonder if anyone can help me with a query.... I have been employed within the healthcare industry for the same employer for 7 years. He has now decided due to his age really that he is selling his business to another gentleman in the same town.Even tho he is intending to work at the new place too he will have no say as to how it is run. He has been upfront from the very beginning and told us what he was doing although he cant at the moment tell us when the business transfer will happen as there is a lot of red tape involved. As the weeks are progressing tho there is a little un rest as in we are all worried about what is likely to happen, as we have no contracts just implied contracts. We are all basically part time and so none of us really want to be forced to do more hours or in some cases even change the actual days we work at the moment as we all have commitments. Does anyone know how we stand if the new employer wants to increase our hours, or change our working weekdays? Or even insist we do late nights etc?
Thanks
Thanks

Sure someone with knowledge in the area will reply, my opinion is that even though you don't have a written contract, you have contract based on the activities you currently undertake. Do you have anything on things like holiday entitlement, sickness etc...
TUPE maybe useful to read - http://books.google.co.uk/books?id=FntPPmLpVhAC&lpg=PA77&ots=HGOhGB3xXg&dq=%22no%20contract%22%20tupe&pg=PR1#v=onepage&q=%22no%20contract%22%20tupe&f=false0 -

Oh thanks for that Timmers. It has put my mind at rest slightly. We shall just wait and see now what happens nearer the transfer date.
Thanks again0 -
Sorry forgot to say. No I dont have anything in writing about sickess holiays etc. Just word of mouth. The current boss has recently sent our line manager round with information forms which SHE filled in about holidays, sickness, any benfits we currently have, pensions, working hours and currently hourly rates. Although we did not sign this form, she was told that only her was to fill then in and that we were to agree to everthing she was writing.I hope this does not not pass as a conract?0

Well you won't "agree" it if it isn't correct will you? And IIRC, unless it says its a new contract of employment specifying those conditions then it isn't a new contract. If it's supposed to be formal documentation of the terms of the verbal contract you currently have in place (which is a damn good idea for the protection of both "sides") then its up to you to not approve it if you think its wrong. If you don't stand for something, you'll fall for anything0
