anyone know an update to the test case

Anyone know what is happening i thought that we would have a resolution this month?

    Which test case? There are several going on depending on what area you are complaining about.

    Currently the Supreme Court(used to House of Lords) are considering whether the bank charges terms are assessable for fairness. If they decide that they are then the next stage is further court litigation which will decide on the fairness of charges, refunds etc, etc,.
    The Appeal the banks made to the House of Lords, win lose or draw will not bring an immediate refund of charges and I would say we are almost at the half way mark.

    We were expecting that it might happen in October 2009 because the House of Lords didn't decide the case by July so October was the earliest date. I suspect middle of November(but it is a pure guess on my part and not based on any other reason).

    im hoping that its dotting the i,s and crossing the t,s as far as bank charge refunds are concerned,they better hurry up though as im sensing a great discontent with banks the f,o,s and the house of lords from all quarters regarding this,they siad october for a decision and its the 28th october now so what are they playing at,one big runaround sending people crazy is not the way to bring this to an end,mr banker its time for a swift decision,ie now...........................:money:
    missed direct debit charges,very odd,theres no pain so how come the big gain,i.e £39.00 for a letter

    This decision we are awaiting is nothing to do with refunds so if you have your hopes up high then you will be disappointed. The likely date for a decision is November 19th so keep that date in mind.

    what is the decision then to be made on the 19th november,surely refunds should be getting sorted soon,this is getting insane,in fact its becoming quite childish of the banks,and to be honest,insulting to my intelligence if they think i for one dont know the pathetic juvinile game they are playing.:money::money:

    They aren't deciding if the terms are fair or unfair so the answer is that until we have more litigation then refunds are not on the table. Everything depends at the moment on whether the terms are assessable for fairness under UTCCR 1999.

    Who are ''they'' ?

    If you're referring to the Supreme Court, 'they' didn't say October or indeed give any indication whatsoever as to when judgment was expected to be handed down. October was only ever an assumption by the media and forums.

    According to the Listings Office at the Supreme Court Lord Phillips is nearing completion writing his judgment and Thursday 19 November ''may be a suitable date'' to schedule the handing down.
