Return Rights On Faulty Discontinued Items

I have a question about an LG Blu-Ray/HD-DVD drive I bought from eBuyer in January. The item has recently become faulty and so my first point of call was LG support, they went through some items with me and said they thought it was faulty but that within the first year I should return to the Vendor (eBuyer). I submitted an RMA request to eBuyer including the LG support ticket number. The RMA was accepted and the item was sent back to eBuyer.

2 days ago I got an email back from eBuyer confirming the fault and that a replacement had been ordered. However the problem is that this drive (and most like it) have been discontinued due to HD-DVD losing the HD battle. So naturally I got an email saying it was out of stock. I called up eBuyer and asked them what my options were, they said I could choose an alternative product or get a full refund, when I said I would like an alternative product they stated to me that the only product matching the specification of my returned drive (obviously without the HD-DVD support) was £15 more than my original purchase and I was going to have to pay the difference.

Now my real question is surely they need to supply me with an item of equivalent specification to replace my faulty product. I fully understand that HD-DVD is dead and I cannot have a product like that anymore, but why should I lose out twice by paying again for a product of lesser specification than what I started with? eBuyer are saying they have no movement on this, its either refund or direct store credit.

Does anyone have any advice? Can I ask within my rights for an equivalent product that meets the specification of the faulty product? Or am I stuck with a full refund? What is LG's role in this? I cannot find their warranty details anywhere and I sent back the whole box with the details :(

    and as for your case, you dont have much more to put to this case

    unfortunately hd dvd is dead so thats out the question

    i think you have been a rare lucky case as you have been offered a full refund after usage of a product, surely that a plus? id take it, and put the money towards a bluray player maybe with hd dvd built in also so you have future support of new releases


    i cant see much more of a positive situation really.

    Legally Ebuyer have to offer a Repair, Replacement or a refund, but it is their choice which one you have. As they have offered a full refund (incidentally they can make deductions based on how much usage you have had) they are acting within the law and being very fair, i would accept their offer.

    I'd go for the refund and get a Blu-ray player instead. Sounds like a blinding deal to me. Otherwise you'd have a pretty much useless HD-DVD player!
  • Thanks for the replies guys, I guess I will take the refund and then look out for a cheap Blu-Ray in a few months. I guess like for like doesnt apply for warranties :(

    sometimes it does for extended warranties like curries but not standard ones no.

    like another poster mentioned, repair, replace, refund is all they have to offer you

    Well it was already a Blu-Ray player, it played both (hence why I purchased it as I was unsure which would win the "war") The bit that frustrates me is that the nearest equivalent - an LG Blu-Ray retail boxed with the Cyberlink PowerDVD software (the expensive bit) - is £15 more than I paid for a drive that did exactly the same AND HD-DVD.

    But as people are saying it seems like I am lucky to get offered a full refund ...

    Again, thanks for everyones replies, in the end i took the refund as store credit together with a free P&P voucher, I then ordered a plain old DVD-RW and some blank media and then cashed the rest to my bank.

    The only reason I got the drive in the first place was because it was only £50 and I could pick up the HD-DVD for £1 :) Now the next best Blu-Ray is £79.99 and I don't own any so not worth it ...

    As for the PS3 suggestion, without starting a Xbox vs. PS3 thread, #1 they are too expensive, #2 there are no decent games compared to xbox, #3 the online services/chat are nothing compared to the xbox (Yes I know PS3 is free, but Xbox LIVE is not that expensive), #4 Microsoft are rolling out some really nice features on xbox imminently. The only plus is the blu-ray ... yes I am an xbox fan and an xbox owner ;)
