Private arrangement check list

Hi,
I am the NRP and my son lives with his dad. I have been paying CSA payments through the CSA for the last 6 months or so for my son, but my OH is about to be made redundant.
So i have to spoken to Ex and we have come to an agreement that he will tell CSA to close the case and we will have a private arrangement so that OH and me can have time to get finances etc sorted (we have 3 children at home)
Luckily ex and i get on quite well and he fully understands my situation.

Got text today to say he had spoken to CSA and they are closing the case and i should await letter to say it has been done

So, my checklist is as follows

wait for closure letter
Set up standing order to ex when finances sorted.
Ensure it specifically states what the money is for

Can you please tell me if there is anything i else i should be doing to ensure that i dont get any come back on myself.

    If you can get all this in writting and have both of you sign it and witnessed by a friend or someone ((Not your OH or his if he has one)) that would be the best.

    I would call the CSA yourself and advise that this is the case, and ask what they think you should be paying. They will advise and you then decide of you can afford that.

    You get on now, but you mihgt not in the future. that has been my downfall. He might ask for backpayment.for example you pay £50 a month, when the (CSA think you should pay £100).he calls in 10 months time and says you've only paid £50 a month he wants backpayment. they decide you owe £1000 and do a DOE (deduction from earnings)

    The new rules of CSA state you can pay through them or privately, and they will advise. that is what they prefer

    At the minute i pay £5 per week as i do not work. I was going to offer to carry on paying this until i get myself a job in the next couple of years, and i will also buy clothing and shoes for my son.
    So, can he ring them up in say 2 years time and say he doesnt think ive paid enough (even though it will be the smae as what i am paying through the CSA now) and can then ask for back payment even though the current case is closed?

    reason i ask is that my son has lived with his dad for the last 5 years and when he applied for CSA (due to being on JSA 6 months ago) they did not ask for the last 4 1/2 years payment

    If the case has been closed he won't be able to ask for backpay. The CSA shouldn't be involved until they contact you again (if they do).

    Your list sounds about right. A signed off receipt would be good or maybe an email from the PWC confirming receipt of it, the amount, date and what it was for.

    I hope a private agreement works well for you both x

    Part in bold is incorrect, if the case is closed with no arrears the CSA don't back pay.

    So am I right in saying the following ::

    You have been going via the CSA, Paying every month as normal, PWC then decides to go for a Private agreement.
    Then a couple years later PWC decides that they want to go back through the CSA, then they cannotask for back pay or "arrears" ?

    The reason I ask this is that i am married to the NRP who has been paying his ex for his 2 children, however whch way she wanted it, loads of crap and to many details to go into, however, she has now decided that she wants to go back through the CSA. Slyly and bloody lying through her theeth she is trying to claim back oney from last year. The CSA told us that they only want money from the tme she put in this new claim, as she closed the case.

    Can they chase us for back money ( even though we paid her anyway) or do they not count that ?

    As far as I'm aware when you close a case with the CSA they ask the PWC if there is outstanding arrears do you want us to collect them? The PWC can say yes or no.

    If the case is closed with no arrears and the PWC decides to re open the case then it is a new claim a fresh start so to speak.

    Just make sure you set aside some money every month until the CSA has done the new assessment ;) depending on how long they take you make start to have arrears through no fault of your own.

    I think you need to have it very clearly stated by the CSA that the case is CLOSED and not just put on hold or something ... like has happened to the person in the other thread going on here at the moment.

    I would want something in writing from the CSA stating "We confirm that from the date your account was closed (??/??/????) you will not accrue any arrears whilst you have a private agreement with the PWC. Only if the CSA are contacted and the account opened again will we be involved in your child support payments". Or something along those lines lol
