DVLA Problems V5 Since 2006!

Right here goes:
I bought a car from a dealer on 14/10/2006 it was a mere 2.5 years old. I signed the paperwork for the V5 (which I never personally recieved after). The car had 12 months tax - becomes important.
At this time I had two cars including the new one. The old one has to be scrapped which it was a couple of weeks later. The company doing this asked my mum for some more paper work (I was only 19 still at home student) of which she gave them. Now she gave them the documents for both cars instead of just the old one. I never had the new one in my hand ever or saw it. This lead to (on paper anyway) both cars being issued a destruction certificate (crushed/cubed). However my new car has never been cubed.
The problem did not come to my attention untill the tax ran out and I needed to retax. The police stopped me - but were ok and made me aware of the problem and let me carry on. The garage seemed to be rude and my mum contacted the scrap yard with no luck.
Over the 2 years (from when tax ran out - as were unaware of the problem till then) we have sent several letters to the DVLA with little luck.
Finally, this month the vehicle was inspected and VIN numbers checked at the nottingham office. I rang on the 26/10/09 to check progress they said it passed V5 on way shortly.
However, today I get a call from the guy dealing with it saying the vehicle has been flooded and is in bad condition and therefore unroad worthy, I will not be getting my V5. I must say this car has never ever been flooded and is absolute nonsense! He said he was just referring to the report given.
Therefore, I had the inspection officer contact me who said the car was not flooded but it possibly could have been but the reason the car was not allowed a V5 was because it has taken 3 years to get this 'sorted'. Now I explained that wasnt what I was told and she said she could so nothing because a certificate of destruction was issued??? Conflicting stories!
Needless to say I am waiting to hear back, what can I do?
Basically: Mum scrapped my car - not licenced to do so.
If flooded in past what can I do against garage and prove it was done prior to purchase?
How do I get V5?
The scrap yard should match vehicles to V5 (reg doc) before scrapping which they did not do?
I am really needing to sell carand need sound expert advice?

further update the vehicle was reported to be flooded when scrapped.0

Wonder if you bought a vehicle that had originally been flooded & written off by the insurance.
Seems after the major floods, some dodgy people bought these cars which should never have been put back on the road, Broken for salvage only. They have clamped down on this now, you cannot buy one without holding a dismantlers licence.
Seems some made their way back into circulation. Probably why a V5 was not issued, But somehow slipped the net saying the vehicle should not be on the road.
As for the scrapyard matching the vehicle to the V5 then i presume they did do that, The fact you may or may not have given them more paperwork than they needed. Im sure some people think they are being helpful by giving them old MOTs & service books etc.
As long as the driver picking up the vehicle had seen the V5 for that vehicle he wouldnt have checked any other paperwork. Just hand it all into the office. IF the other V5 was also there the office staff may have stamped it destroyed & sent it off with hundreds of others.
Tried an HPI check? Should have the insurance dates if it was written off.0 -
Hi,
I am the owner of the vehicle. I bought the car on 14/10/06 from a car dealer. The car was scrapped after this date on paper only.
A HPI check comes up no vehicle as the car is 'cubed' but has never been near a scrap yard.
The scrap yard should never had classed the car as scrapped and is still in my possession.
I signed the V5 at the dealer ship and they sent it off-the last I saw of it.0 -

Have you spoken to the DVLA?
They may require you to take it for an identity check.
If they say the vehicle has been scrapped and never to be put back on the road you could try for a Q plate, Kit cars etc can have these, Can make them hard to sell though.
A Q plate cannot be exchanged for any other plate.0 -
Thanks for your reply. The DVLA already did an identity check and that was fine, I think they are just being awkward because I complained about it and also because it has taken so long.
With regards a Q plate, we did discuss this and since I need to sell it would devalue too much and why should I loose the money because of other peoples mistakes, I have contacted citizens advice and hopefully have a legal representative to take action for me as I dont see why I cant get back the full car price since it was scrapped since I owned it and proper procedures weren't followed - but I would rather just get my log book and have it done with.0
