i want to contest a parking fine!

My husband, yesterday, received a parking fine grrrrr!!!!! It was in a council run car park. The only signs we saw were that people would get a penalty if they stayed longer than one hour. (we stayed about 40 minutes but that is irrelevant)
My husband was fined for not parking within the marked bays! He parked out of the way - (not in a bay) but not causing an obstruction, nor on double yellow lines etc.
My argument is the signs only state a fine would be issued if you stayed longer than 1 hour.
I've looked on the councils other car park signs and THEY clearly state for that certain car parks, cars must be parked within bays. But the car park my husband parked in - it did not state this.
I have appealled - how good a case have I got!
Also, if they say we must pay the fine - can the fine payment be spread out? we can't afford this much in one payment.
