Points on licence

Any legal minds out there ?

Daughter was stopped for speeding whilst we were away (38 in a 30) and got a fixed penalty, she also had to produce her documents at the police station as she had just moved back in with us but had not changed her address. She rang the payment line and paid the fine and has a statement from her credit card to confirm this. The police sent off her licence and it arrived back yesterday from the DVLA with new address changed BUT no points.
So the question is what should she do, does she go back to the police station and ask them or just keep quiet? It would be the only points she would have on her licence.

She told the insurance company but they said unless they are on the licence (paper part) they can not add them to the system. 3 points would not alter her premium from them at least as she is 25

  • She will get a letter from DVLA within few weeks saying that she needs to return licence again to be properly endorsed. She can pre empt this by ringing DVLA, but it will catch up with her. It would have been original endorsed by the courts not DVLA so when it went to DVLA for address change it would not yet have shown the points on the computer when the new licence was printed.

If it were me, I wouldn't do anything. You've complied with the law, you've produced what was required to be produced. If they've cocked up, let them jump through hoops to fix it; there's no need for you to do so.

When the OP's daughter is stopped by the Police, has her vehicle taken as she has a revoked licence, a £150 recovery bill and all the other costs and hassle. They'll be very glad of your advice.

They'd have to revoke it first. Once they send that letter demanding return, they'll have to comply.

She has NOT been notified of any points, the OP just expected them. As such surely no need to declare point owt the insurers, Just details od the offence/incidence

Yes missed that, does seem like an upcock. But I too would do nothing. However to answer the standard, "have you been convicted of any motoring offence over the last 5 years" question at renewal time will prove eventfull, they don't ask If you have points.;)
