Can I record a meeting without telling the other person?

    Is it one with a tape? I hope not as he may hear it. And if it is in your handbag, tbh the chances of you picking up anything audible would be remote.
  • Can't you just use the recorder on your mobile phone? Keep it in your pocket and switch it on when you need to. There is no need to worry about the tape clicking on or off then. I have used my phone to record OH snoring in the past!

    Most MP3 players have a recorder on them too, or your mobile phone.
    Should've = Should HAVE (not 'of')

    theres a few in RM that tape meetings etc with managers just so the have a record of what was said

    If he does the same, you could notify HR that he's blackmailling you, and tell them you did record the conversation, so have proof, but can't play it to them as you didn't request his permission to record the conversation. You might be able to play it to them "off the record" though...

    The first point is correct. be prepared however for him to have a justified case of misconduct if you shared that recording in any way whatsoever. there are also questions around privacy and an individual's expectation of privacy, regardless of what it is they're saying. a very sticky area, i would err on the side of taking a rep in with me instead.

    Make sure you divert all calls beforehand if you are using the phone. If it rings, it will no longer be recording. ;)

    I answered this in another thread, but will repost here.

    start dictaphone recording then conceal in pocket/bag whatever
    walk into room, greet interviewer, sit down
    take paper work out and pen and say "ok if i take some notes"
    interviewer id imagine would not have problem "sure no problem"

    this would be the official permission that you could take notes, obviously he has seen the paper and pen and assumes that is all you meant but he has unwittingly allowed you to take notes by use of the dictaphone.

    meanwhile any incriminating questions are recorded on the dictaphone, nice insurance for any potential unfair discrimination.

    Besides, since he knows you are writing notes, you can always fill in the gaps you miss but the recording picks up. :D;)

    The recording itself will almost certainly not be allowed to be used and you would be best of not revealing you have one unless backed into a corner. Instead use it as a 100% accurate transcript to then base your notes and further action from.

    It's not ideal but needs must in difficult circumstances.

    Im interested why you think it would not be allowed to be used? Check this following link. It seems that a covert recording even without the permission is entirely admissable as valid evidence.
