    It's up to the family to stump up the cash, they've not followed the correct procedure to cancel & as such due to the terms & conditions of the deposit for the holiday, they took the full amount.

    Only a fool would chase the company in the court as they nor the credit card company have done anything wrong, focus your attention at your friend as its them who has cost you an arm & a leg.
  • Many thanks again to those who took time to reply . I went ansd saw my solicitor today regards this issue and they are sending letters of to flight company and credit card company to ask why i was never contacted regards the offer .
    I could take the family member to small claims over this but if they aint got the money they could be forced to pay back at £1 a week .
    Normanmark i dont see how you are saying the credit card company have done nothing wrong , they authorised a payment of £1900 on my card for something that wasnt even in my name .Last week i went to pay for a tumble dryer online using another credit card and it was declined , when i phoned them the following day for an explanation i was told this looked suspicious :confused:
    Only wish this kind of check had of been applied on the mbna card

    Well you allowed the first transaction to go through on the card for the deposit, it would make sense then for the rest to go through on the card. You can't turn around & expect that the credit card company know the complete story as to why you paid the deposit for someone else's holiday in your name.

    I'll break it down to highlight where i think the focus should be:

    Holiday company - They've not broken any rule, their terms were that if you don't pay x amount then they'll take the full payment. Just so happens they took the original deposit on your card.

    Credit Card company - You paid for their deposit on your card, which basically will state that you're aware of the terms & conditions of paying that deposit with the holiday company and that if there's any complications of payment then they'll take x amount. They're not mind readers & the obligation to address the company to stop the payment isn't theirs. Its yours.

    Friend/Family - They should pay up with regards to this, they should have read the terms & conditions and not take advantage of your friendship like this.

    I can understand why you'd want to chase the CC company, but in reality its the friend you should be chasing as its them that has technically defaulted on their contract with the holiday company. Probably not the news you'd want to hear, but hopefully it'll make you think before considering chasing the credit card company as it might not be a successful outcome.
