  • Placing him at the top of the list because he is asking for what he is legally entitled to is not going to do his boss any favours. In selecting for redundancy from a pool of people he would have to use a matrix. If your OH is selected as part of this matrix he could challenge it.
    FYI I had a similar situation with my sister, she was being unfairly treated and they decided to restructure and lo and behold she was selected. She got nowhere with her union and so I prepared her case with her. As a result she was reinstated but she felt this was unfair on the other staff as one of them would have to go, so they ended up making an additional payment over and above her redundancy with an agreed reference.

    ACAS website should give the basics. Used to be a BERR site too - think if you go to that it may redirect you to the government site.
