Curves Gym Injury/ Eazi Pay Direct Debit Problems!

Last week, after a weeks free trial, I joined Curves after my Aunt persuaded me that she loved it (she had been going for about a month). I signed up for a four month direct debit as this was the cheapest and TBH the only option offered to me although now I know there were other options. Anyway, I didn't think it was great but it was easy and I thought that it would help me get kick started with an exercise regime, I planned to leave after 4 months however as I though it wasn't great value for money, there was a lack of atmosphere and I could see I would get bored with the circuit/gym eventually.
So, last week my Aunt started getting pain in her knee. It was so bad she could hardly walk. Now it is in both her knees and the sports therapist has said she will need keyhole surgery. It has now come out that her injuries are due to repetitve trauma at Curves. Meanwhile, after one session, my elbow (which I have never had bother with) started to become painful. It would go away, then come back whenever I had been at Curves.
The girl that owns the gym is a bit ditzy (same age as me early 20's) and doesn't come across as mature, she also complains of knee pain and stiffness and she doesn't really tell you how to use the machines properly - I don't think she has a clue. Her mum is a trainer there and met her for the first time on my 5th session and she told me I hadn't been using the machines safely. TBH alot of the time they just seem to want to talk rather than show you how to use the machines correctly. Also my feet don't touch the ground on the machines and I've since found out they are made for women between 5"4 and 5"8 - I'm only 5"2 and as a result they should have been giving me pillows to support my back. Anyway, my Aunt is practically crippled at the moment and I am concerned that I don't want to do myself a serious injury in my 20's which could affect me for the rest of my life. I also don't have £120 to throw down the drain. Today my direct debit notification letter came through and for some reason TWO direct debits with Eazipay have been set up instead of one. I am fuming, have been on the phone to Eazipay all day trying to enquire why this has happened, and keep getting the answering machine. When I leave a message no one gets back to me. Have also contacted the Curves branch and no answer there either. I have e-mailed explaining the situation so hoping for a reply. I have offered to pay for the one session outside of the free trial which I went for. My bank advised me to cancel the direct debits which I have done but also said that if I signed a contract with Curves (which I did) they can take me to court. I never got a copy of my contract either. Is there usually a cooling off period with these things?

Any advice how to get out of this 4month contract?

    So basically you don't fancy going so your going to claim every small pain is their fault. I am willing to bet that no GP will give you a proper letter stating Curves are to blame.
  • No thats not it at all - please read my post. I'm not trying to claim anything, I just don't want to risk any further injury by going back. I have offered to pay for the sessions by cheque instead of direct debit. My Aunt is being referred for an OPERATION because of what has happened to her so she will have no problem getting a Doctors letter. As for me, I was just told not to go back there. But neither of us plan on suing anybody. I just want to cancel my contract rather than pay £120 for gym sessions I have never had and will never have. Its nothing to do with not fancying going back, I want to exercise but I don't want to have to put my health at risk by going back there.

    Without a doctors letter stating their to blame or neglient your going nowhere.
  • Thanks, I don't think I'll have any problem getting a letter from my GP as its well documented (was keeping me up in the night and giving me problems at work as I'm a performing arts teacher and couldn't play the piano two days last week after gym sessions). And obviously my Aunt won't have any problems either as her physio actually called them to tell them that it is due to their negligence.
  • Just to say this problem has been resolved this morning in case anyone thought I needed any further advice. Had a nice letter from Curves saying that in the light of what has happened they have no problem with the cancellation of the contract and Eazipay have also called to confirm they have stopped the direct debit. Nice to have it all sorted, just need to find a safe gym now, luckily the physio has recommended a good one for once I'm better :j.
