Can they do this?????

Hiya all
I went online last week to check if my working/child tax credits hd been paid in to my account as i do on every Tuesday. I notied t my horor that my balance was minus £38 after over £200 had been putin that morning. I looked at my account and noticed a charge of £228 had been taken out that morning. In my anger i telephoned the bank to be told that it was for 6 direct debits that had been returned over the past 3 months and i had been sent an email telling me that it was being debited. I never recieved such an email. The snotty women on theother end of the line said " YOU SHOULD EXPECT THIS IF YOU ASK FOR DIRECT DEBITS TO BE TAKEN OUT YOUR ACCOUNT KNOWING YOU DON`T HAVE THE FUNDS TO COVER THEM" I blew my top at her attitude and the way she spoke down to me and asked to speak to her supervisor . The supervisor apologised and offered me one of the charges back as a way saying sorry . I accepted but then queried why twy could giv me one cargebac but not the others as i had no notification of them being debited from my account. He said that as the charge case was in the court system they could not do any more than what he has done but he could not answer if our claims are on hold then why are the charges not on hold.

My question is if i am not told of these charges being debited is it legal for them to still take them out. The bank in question is Natwest for anyone who is interested

    You would have been notified of the charges in your bank statement. If you haven't received a statement due to postal strike or something to that effect. Otherwise you would have been able to view the notification on your online banking.

    To be honest I would have said the same as the advisor you spoke too "YOU SHOULD EXPECT THIS IF YOU ASK FOR DIRECT DEBITS TO BE TAKEN OUT YOUR ACCOUNT KNOWING YOU DON`T HAVE THE FUNDS TO COVER THEM"

    If you feel the direct debits have been taken in error. You should maybe approach the companies involved and ask them for a refund of your charges. At the moment while the test case is ongoing you will be charged as normal.

    The charges are on hold because the current part of the OFT test case is not about whether the charges are fair or not but whether the charges can be assessed for fairness. If you have your hopes up for the Supreme Court to decide the case and refunds to then come from the back of this then you are going to be very disappointed. I think you need to start the process of reclaiming.
